Individuals who rented a deregulated apartment at 90 Washington St. in New York City before June 30, 2018, and lived in the building after June 14, 2015, may be eligible to claim a cash payment from a class action settlement.

JDM Washington Street LLC agreed to pay $1,739,811 to settle a class action lawsuit alleging it overcharged tenants and failed to provide rent-stabilized leases while the building received 421-g tax benefits.

Who can file a claim?

Class members must meet all of the following criteria:

  • They signed a lease to rent an apartment at 90 Washington St. before June 30, 2018 (the date the building stopped receiving 421-g tax benefits).
  • They resided in the building at any time after June 14, 2015.

The settlement covers both current and former tenants who meet the above criteria. Those who lived in more than one apartment in the building during the relevant period may be eligible for multiple claims provided they include all addresses and lease dates on their claim form.

If multiple co-tenants signed the lease for a unit, each must file a claim to receive their share of the payment. Co-tenants who do not file a claim will not receive payment, and if any co-tenant opts out, the settlement considers all co-tenants opted out.

Who is excluded from the class?

The settlement excludes tenants who vacated their apartment before June 14, 2015 (unless they moved to another apartment in the building), and tenants whose occupancy at 90 Washington St. began after June 30, 2018.

How much can class members get?

The total settlement fund is $1,739,811, which the settlement administrator will distribute among eligible claimants after deductions for attorneys' fees and costs, and service awards to the class representatives. The amount each class member receives depends on several factors, including the amount of rent they paid above the legal regulated rent, the period of overcharge and whether they owe any rent to the landlord.

The settlement administrator calculates each eligible class member's award as follows:

  • It sets the legal regulated rent as the amount charged four years before the plaintiffs filed the complaint (Feb. 25, 2016).
  • If the class member paid more than this amount between Feb. 25, 2016, and the date of preliminary settlement approval, they are entitled to a refund of the difference plus 9% simple interest per year calculated monthly.
  • The administrator will subtract any amount the class member owes the landlord from their payment.

Additional information

  • If the total of all valid claims exceeds the net settlement fund, the administrator will reduce payments on a pro rata basis.
  • If a class member's calculated payment is less than $250, they will receive $250.
  • For current tenants, the settlement also sets a new "settled rent" for their apartment, which will become their legal regulated rent moving forward. The settlement website lists settled rents for specific units. They range from $1,900 to $4,175 depending on the apartment.

How to claim a class action payment

Class members can download the PDF claim form, complete it and mail it to the settlement administrator. There is no online claim form.

Is proof or documentation required to submit a claim?

Yes. Class members must provide details such as the address of the apartment(s) they rented, the start and end dates of their lease(s) and the names of any co-tenants. They must also sign the claim form under penalty of perjury, attesting that the information is true and accurate.

Those filing as a legal representative (e.g., executor or administrator) must indicate their capacity and provide their information.

Those submitting a joint claim must have all co-tenants must provide their information and signatures.

Payout options

Th settlement administrator will mail a check to the address the class member provides on the claim form.
