Employees whom 48forty Solutions LLC notified by mail in 2022 that their personal information may have been compromised in a data incident may be eligible to claim up to $2,825 plus credit monitoring from a class action settlement.

48forty Solutions LLC agreed to settle a class action lawsuit alleging it failed to adequately protect employee personal information during the December 2021 data breach.

Who can file a claim?

Class members must meet the following criteria:

  • 48forty Solutions LLC notified them by mail in 2022 that the December 2021 data incident potentially compromised their personally identifiable information.
  • They resided in the United States at the time of the incident.

There is also a subclass for individuals who resided in California at the time of the data incident.

How much can class members receive?

Class members may claim any combination of the following benefits:

  • Ordinary expense reimbursement: Up to $275 per person for documented, unreimbursed out-of-pocket expenses most likely related to the data incident. Eligible expenses include:
    • Credit report costs
    • Credit freeze fees
    • Card replacement fees
    • Late fees, over-limit fees, payday loan interest and other bank or card fees
    • Postage, mileage and incidental expenses due to account issues
    • Up to one year of credit monitoring or identity theft insurance (if purchased primarily due to the incident)
    • One to three hours of lost time at $15.50 per hour for time spent addressing the incident (description required)
  • Extraordinary expense reimbursement: Up to $2,500 per person for documented, unreimbursed fraudulent charges or out-of-pocket losses most likely related to the data incident and not already covered by ordinary expense reimbursement. To qualify, claimants must show:
    • The loss is actual, documented and unreimbursed.
    • The data incident caused the loss.
    • The loss occurred between Dec. 31, 2021, and Dec. 22, 2025.
    • The loss is not already covered by another category or reimbursed elsewhere.
    • They made reasonable efforts to avoid or seek reimbursement for the loss (including exhausting available insurance).
  • California statutory damages: California residents may claim up to $50 in statutory damages.
  • Credit monitoring: All class members may enroll for one year of free access to CyEx’s Financial Shield Services, which provides financial account monitoring and identity protection. They must complete enrollment within 90 days of the settlement effective date.

The settlement administrator will reduce payments if the total value of all valid claims exceeds the aggregate cap of $250,000.

How to claim a settlement payment

Class members can submit the online claim form or download, print and complete the PDF claim form (Page 33) and mail it to the settlement administrator. The claim deadline is Dec. 22, 2025.

Information required

  • To file an online claim, class members must provide the class member ID located on the postcard and/or email they received. Those who did not receive a postcard or no longer have it should call 866-742-4955 or email info@rg2claims.com.
  • To file a mailed claim, class members must provide either their class member ID or the name and address or email they used with 48forty.
  • To claim ordinary or extraordinary expenses, class members must provide receipts, bank or credit card statements, or other proof for claimed expenses (with unrelated transactions and all but the first four and last four digits of account numbers redacted).
  • To claim the California residency payment, those whose mailing address 48forty had on file at the time of the Dec. 31, 2021, data Incident was a physical residence located in the state of California only need to provide the address.
    • If the mailing address 48forty had on file at the time of the data incident was NOT a physical residence located in the state of California, the class member must provide proof of California residency, such as a mortgage statement, utility bill or property tax statement.

Payout options

  • The settlement administrator will mail checks to the address provided on the claim form.
    • Class members must cash their checks within 90 days of issuance.
  • Class members received a redemption code to CyEx’s Financial Shield Services on their mailed settlement notice.

Settlement fund breakdown

The $250,000 settlement fund covers:

  • Settlement administration costs: $34,086
  • Attorneys' fees and costs: $100,000
  • Service award to class representative: $2,000
  • Credit monitoring costs: Dependent on number of valid claims
  • Payments to eligible class members: Up to $250,000

  • Fairness hearing: Feb. 27, 2026

When is the 48forty Solutions LLC settlement payout date?

The settlement administrator will mail checks to eligible claimants approximately 45 days after it resolves any appeals and the court grants final approval to the settlement or within 30 days of the date that the claim is approved, whichever is later.

Why is there a class action settlement?

The class action lawsuit alleged 48forty Solutions LLC failed to take appropriate measures to protect employee personal information from a cyberattack in December 2021. The data incident allegedly exposed names and Social Security numbers of current and former employees.

By settling, both parties avoid the costs and risks of continued litigation, and affected individuals can receive compensation for their losses.
