
A $2.67 billion Blue Cross Blue Shield antitrust settlement will begin paying out on May 11, 2026.
On April 23, 2026, subscriber plaintiffs filed a motion in the U.S. District Court for the Northern District of Alabama asking the court to approve a distribution plan for nearly 7.8 million claimants.
What the lawsuit alleged
The case began in 2013, when subscriber plaintiffs filed antitrust claims against roughly 35 Blue Cross Blue Shield entities. The plaintiffs alleged the companies divided the country into exclusive service areas and restricted competition among the regional Blue plans. That conduct drove up premiums and limited choices for millions of policyholders, the complaint claims.
The Blue Cross Blue Shield Association licenses the Blue Cross and Blue Shield trademarks to regional insurers known as Blue plans, which operate independently across all 50 states. The proposed class covered individuals and companies that bought or received health insurance through one of those plans during the relevant period.
How the case moved through the courts
The court structured the case as a multidistrict litigation, a federal procedure that consolidates related lawsuits into a single coordinated proceeding under one judge. The parties reached a settlement on Oct. 16, 2020. Judge R. David Proctor granted preliminary approval that November and final approval on Aug. 9, 2022. Objectors appealed. The U.S. Court of Appeals for the Eleventh Circuit affirmed the settlement in 2023, and the U.S. Supreme Court declined to take up the case.
The notice and claims process
The court appointed JND Legal Administration to handle the settlement notice and claims process. From March 26 through May 31, 2021, JND sent more than 100 million direct notices to potential class members through postcards and emails.
By the filing deadline, claimants submitted 8,421,346 claims. JND approved 7,774,992 for payment and recommended rejecting 646,354. Each rejected claimant received notice of the deficiency and a chance to fix it.
How the administrator will calculate payments
The settlement administrator will distribute funds on a pro rata basis. Each approved claimant's payment will be proportional to their recognized claim relative to the total recognized claims of all approved claimants.
- Claimants whose calculated payment falls at or below the $5 de minimis threshold will not receive a distribution in the initial round.
- Claimants with a calculated distribution of less than $200 will receive their full payment in the initial round.
- Claimants with a calculated distribution of $200 or more will receive 90% in the initial round with 10% held in reserve for a second distribution.
- Claimants can receive funds by check, PayPal, Venmo or electronic debit card.
What this means for Blue Cross Blue Shield claimants
If the court signs off on the motion, JND will begin sending payments on or about May 11, 2026. Approved claimants do not need to take additional steps to receive their share.
