Can I Claim an Award?

To be eligible for a settlement award, you must have purchased certain non-grocery items at a WinCo store located within the City of Portland, Oregon, and paid a surcharge on those items between June 1, 2019, and May 8, 2022. This means that if you shopped at WinCo during this period and bought non-grocery items that had a surcharge, you may be a class member entitled to a cash payment.

The settlement class includes all individuals who fit the criteria mentioned above. There are no additional tiers or categories of class members in this settlement. If you meet these criteria, you are automatically considered part of the settlement class unless you choose to exclude yourself.

What Can I Claim?

Class members who submit a valid claim form can receive a cash payment of up to $200. This amount may be subject to a pro rata adjustment depending on the number of valid claims filed. The total settlement fund is $3,365,000, and the actual payment amount will be determined after deducting attorney's fees, costs, and other expenses.

The cash payments will be distributed from the settlement fund, which also covers the costs of administering the settlement and notifying class members. Attorney's fees and costs, as well as a service award for the class representative, will also be deducted from the settlement fund.

Items Covered by the Settlement

The settlement covers non-grocery items purchased at WinCo stores within the City of Portland, Oregon, between June 1, 2019, and May 8, 2022, that had a surcharge applied. These items include, but are not limited to:

  • Household goods
  • Personal care products
  • Electronics
  • Clothing

Is Proof Required to Claim the Reward?

Yes, proof is required to claim the reward. Claimants must provide the following information:

  • The WinCo store address where the non-grocery items were purchased and the surcharge was paid.
  • The approximate date(s) of purchase.
  • A description of the non-grocery items purchased.

$3,365,000 Settlement Fund

The settlement amount was calculated based on the estimated number of class members and the potential claims. If the number of valid claims exceeds the available funds, the payments will be adjusted on a pro rata basis to ensure that all eligible class members receive a share of the settlement.
