Class members who received a notice stating their personal information may have been compromised in the Wilson & Co. Inc., Engineers & Architects data breach may qualify to claim up to $10,000 from a class action settlement.

Wilson & Co. Inc., Engineers & Architects agreed to resolve a class action lawsuit alleging it failed to safeguard personal information following an April 2024 data breach. The breach potentially exposed sensitive data, including names, Social Security numbers, banking information, identification details used for visa or citizenship applications and health insurance enrollment information.

Who can file a Wilson & Co. Inc. claim?

Class members must meet the following criteria:

  • They reside in the United States.
  • They received a notice indicating their personally identifiable information was potentially compromised in the April 2024 data incident involving Wilson & Co. Inc., Engineers & Architects.

This includes current or former employees, customers or anyone otherwise affiliated with the company.

How much is the data breach payout?

  • Out-of-pocket losses: Class members may claim reimbursement for documented out-of-pocket losses resulting from the data incident up to $10,000 per person. Covered expenses include:
    • Unreimbursed bank fees
    • Postage
    • Gasoline for local travel
    • Unreimbursed losses due to fraud or identity theft
  • Alternative cash payment: Instead of the above, class members may opt for a one-time $25 cash payment. However, if class members submit more than 800 valid and timely claims for this option, the total payout will be capped at $20,000, and each claimant’s payment will be reduced proportionally.
  • Credit monitoring services: Eligible class members can receive two years of one-bureau credit monitoring services.

Proof and documentation required

  • To submit an online claim, class members must provide the notice ID and PIN from the notice they received. To submit a PDF claim form, class members only need the notice ID.
  • For out-of-pocket losses, class members must provide proof, such as receipts, bank statements or other supporting documents.

Payout options

  • Class members who submit a claim by mail will receive a paper check mailed to the address they provide.
  • Class members who submit an online claim can choose to receive their payment digitally via PayPal, Venmo or Zelle.

The settlement fund covers:

  • Settlement administration costs: To be determined
  • Attorneys' fees and costs: Up to $145,000
  • Service awards to class representatives: $3,500 each ($7,000 total)
  • Credit monitoring costs: To be determined
  • Payments to eligible class members (alternative cash payment): Up to $20,000

When is the Senecal v. Wilson & Co. payout date?

Settlement payments will be distributed approximately 45 days after the court grants final approval of the settlement and any appeals are resolved.

Why did this class action settlement happen?

The class action lawsuit claimed unauthorized third parties accessed Wilson & Co.'s network and certain systems between April 12-April 16, 2024. It alleged the breach exposed sensitive personal information.

Wilson & Co. denies any wrongdoing but agreed to settle to avoid the costs, risks and uncertainties of continued litigation.
