If you purchased a new off-highway vehicle (OHV) for personal use from Temecula Motorsports, Inc. (TMI) between October 21, 2011, and October 20, 2015, you may be eligible to submit a claim for up to $1,140 from a class action settlement.

Temecula Motorsports, Inc. has agreed to pay $1.45 million to settle a class action lawsuit for allegedly charging consumers excessive or improperly disclosed fees and failing to credit manufacturer rebates during OHV purchases. Plaintiffs claim that TMI violated California law by engaging in unfair business practices and false advertising related to OHV charges and rebates.

Who is eligible for an OHV class action payout?

You are a class member if you meet one or more the following requirements:

  • You purchased a new OHV for personal use from Temecula Motorsports between October 21, 2011, and October 20, 2015, and paid a “Prep” charge that included an added dealer markup.
  • You purchased a new OHV for personal use from Temecula Motorsports during the same period and qualified for a manufacturer rebate that was not credited toward the purchase.

How much will the class action settlement payment be?

Pro Rata Cash Payment: The average payment is estimated to be around $350, but could range from $3 to $1,140. Final payment amount will be determined by dealer markup paid and/or manufacturer rebates not credited, and the total number of valid claims filed.

How to claim a class action rebate

To receive a settlement payout, class members must submit a claim. There is no online claim form available at this time. The PDF claim form is available on the settlement website to print, fill out, and mail to the settlement administrator.

Approved claimants will receive a paper check mailed to the address provided.

$1.45 Million Temecula Motorsports class action settlement fund

The $1,450,000 settlement fund includes the following:

  • Settlement administration cost: To be determined
  • Attorneys’ fees: Up to $507,500
  • Attorneys’ expenses: Not to exceed $39,804
  • Service awards to class representatives: Up to $10,000 each for four representatives, no more than a total of $40,000
  • Payments to class members with valid claims: Remaining settlement funds

Any funds remaining from uncashed settlement checks or unapproved claims will revert back to Temecula Motorsports.

When is the Temecula Motorsports settlement payout date?

Checks will be issued to approved claimants approximately 60 days after the court grants final approval of the settlement.

Why did this class action lawsuit and settlement happen?

The class action lawsuit alleged that Temecula Motorsports, Inc. charged consumers excessive or improperly disclosed fees for freight, dealer preparation, and accessories, and failed to disclose or credit manufacturer rebates when selling new OHVs. Plaintiffs claimed these practices violated California law regarding advertising and consumer protection.

TMI denied all allegations, but agreed to settle in order to avoid the expense continued litigation and the possibility of a trial.
