Thermoflex $9M Biometric Privacy Class Action Settlement

Individuals who worked for Thermoflex in Illinois and used a biometric finger-scanning device between July 27, 2015, and Sept. 3, 2020, may qualify to receive approximately $900 from a class action settlement. The settlement class includes 5,874 current and former employees.

Thermoflex Corp., Thermoflex Waukegan LLC, TempsNow Employment and Placement Services LLC and M.M.D. Inc. d/b/a The AllStaff Group agreed to pay $9 million to settle a class action lawsuit alleging violations of the Illinois Biometric Information Privacy Act. The plaintiff claimed these companies collected and used workers’ biometric data, specifically fingerprints, without providing proper written notice or obtaining written consent as required by Illinois law.

Who qualifies for a BIPA payout?

Class members are individuals who worked for Thermoflex in the state of Illinois and used a finger-scanning device at any time from July 27, 2015, to Sept. 3, 2020.

How much are settlement payments?

Cash payment: Eligible class members will receive a cash payment from the net settlement fund estimated to be about $900.

No claim form required

Class members do not need to file a claim to receive a settlement payment.

Settlement fund

The $9,000,000 settlement fund will include:

• Settlement administration costs: To be determined
• Attorneys’ fees: Up to $3,600,000 plus reasonable costs and expenses
• Service award to class representative: Up to $10,000
• Payments to eligible class members: Remaining settlement funds

Important dates

• Opt-out deadline: Oct. 26, 2026
• Final approval hearing: Nov. 4, 2026

When is the Thermoflex BIPA settlement payout date?

The settlement administrator will issue payments to eligible class members approximately 60 days after the court grants final approval of the settlement.

Why is there a class action settlement?

This class action lawsuit claimed Thermoflex and other companies allegedly collected, stored or used workers’ biometric identifiers, such as fingerprints, without providing the required written disclosures or obtaining written consent as mandated by the Illinois Biometric Information Privacy Act.

The defendants deny the allegations but agreed to settle to avoid the cost and uncertainty involved with further litigation.
