Consumers whose personal information the Fortive data incident may have compromised could be eligible to claim cash payments, reimbursement for losses and/or identity theft protection from a class action settlement.

Fortive Corp. and several of its affiliates agreed to pay $3,000,000 to settle a class action lawsuit alleging they failed to protect personal information, which unauthorized third parties may have accessed during two data incidents between Jan. 25, 2023, and Nov. 6, 2023.

Who can file a data breach claim?

Class members must be included on the class list. This includes individuals whose data the Fortive data incident may have been compromised regardless of whether they experienced actual fraud or identity theft.

How much is the settlement payout?

Class members can select one or more of the following benefits:

  • Reimbursement for out-of-pocket losses: Up to $5,000 per person for losses fairly traceable to the data incident with required documentation
  • Reimbursement for lost time: $20 per hour up to four hours ($80 maximum) for time spent dealing with the data incident (such as placing credit freezes, monitoring accounts or remedying fraud)
  • Cash payment: A pro rata share of the net settlement fund of no less than $5 per claimant. The settlement administrator will determine the cash payment by dividing the net settlement fund (after deducting payments for identity theft protection, out-of-pocket losses, lost time, attorneys’ fees, service awards and administrative costs) by the number of valid claimants. If the calculated cash payment would be less than $5, the settlement administrator will reduce payments for out-of-pocket losses and lost time proportionally until the cash payment equals $5 per claimant.
  • Identity theft protection services: Three years of three-bureau credit monitoring and at least $1,000,000 in identity theft insurance

How to claim data breach benefits

Class members can file a claim online or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is Dec. 19, 2025.

What proof or documentation is required to submit a claim?

  • All class members must provide the class member ID located on their settlement notice.
  • For out-of-pocket loss claims, class members must provide documentation, such as receipts, bills or other records that are not self-prepared.
  • For lost time claims, class members must affirm the time spent and select the number of hours (up to four).
  • For cash payments and identity theft protection, class members need only select the appropriate option.

$3 million settlement fund breakdown

The $3,000,000 settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys’ fees: Up to $1,000,000
  • Attorneys' fees: To be determined
  • Service awards: Up to $3,500 per class representative
  • Credit monitoring costs: Determined by number of valid claims
  • Payments to class members: The remainder of the fund

When is the Fortive data security litigation payout date?

The settlement administrator will distribute payments and benefits after it resolves appeals and the court grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged two data incidents affecting Fortive Corp. exposed confidential personal information to unauthorized third parties between Jan. 25, 2023, and Nov. 6, 2023. The plaintiffs claimed Fortive and its affiliates failed to adequately protect this information.

The defendants deny any wrongdoing, but both sides agreed to settle to avoid the cost and risk of further litigation.
