Job seekers who applied for a job in Washington with Tower Engineering Professionals Inc., TEP Opco LLC or TEPDB Opco LLC between March 21, 2022, and Feb. 12, 2026, may be eligible to claim an estimated $1,258.94 from a class action settlement.

Tower Engineering Professionals Inc., TEP Opco LLC and TEPDB Opco LLC agreed to pay between $421,270 and $612,000 to settle a class action lawsuit. The lawsuit alleges these companies failed to include wage scales or salary ranges in job postings and requested applicants’ wage or salary histories, potentially violating Washington state law.

Who can file a claim?

Class members are eligible to file a claim if:

  • They applied for a job opening in Washington with Tower Engineering Professionals Inc., TEP Opco LLC or TEPDB Opco LLC between Jan. 1, 2023, and Feb. 12, 2026, in which the job posting did not disclose the wage scale or salary range, or a general description of benefits and other compensation.
  • They applied for a job opening in Washington with any of these companies between March 21, 2022, and Feb. 12, 2026, and the companies requested they provide their wage or salary history.

The settlement administrator used the defendants’ records to identify eligible class members.

There are two main groups of class members:

  • Pay transparency claims: Individuals who applied for jobs between Jan. 1, 2023, and Feb. 12, 2026, in which the job posting did not disclose required pay or benefits information
  • Salary history claims: Individuals who applied for jobs between March 21, 2022, and Feb. 12, 2026, and whom the companies asked to provide wage or salary history

How much can class members get?

The minimum settlement fund is $421,270, and the maximum is $612,000. If 153 or fewer class members (about 50% of the estimated 306 total) submit valid claims, the settlement administrator will divide the minimum fund equally among them after deducting attorneys’ fees, service awards and administration costs. For each additional participating class member above 153, the settlement administrator will increase the net settlement fund by $1,246.60 up to the maximum fund of $612,000.

Each eligible class member who submits a valid claim form will receive an equal share of the net settlement fund with an estimated payment of $1,258.94 up to a maximum of $5,000. The actual amount may vary depending on the number of valid claims submitted.

The settlement administrator will donate any amount above $5,000 per person to the Legal Foundation of Washington. If fewer than half the class members submit claims, the settlement administrator will distribute the minimum fund to all class members and donate any remaining funds to the Legal Foundation of Washington.

How to claim a class action payout

Class members can file the online claim form or download and print the PDF claim form to mail or email to the settlement administrator. The claim deadline is May 11, 2026.

Class members whose address or contact information changes must update the settlement administrator to ensure they receive payment.

Required information

To file an online claim, class members must provide the notice ID and PIN printed on the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator at info@EPOASettlement2-12-2026.com or 888-369-3780 and provide their full name and mailing address.

Payout options

The settlement administrator will mail checks to the addresses class members provide on the claim form. Checks will expire 180 days after issuance. If uncashed, the administrator will send funds to the state of Washington as unclaimed property.

The settlement administrator characterizes payments as nonwage damages and will report them on a 1099 form.

The $421,270 to $612,000 settlement fund covers:

  • Settlement administration costs: Up to $25,000
  • Attorneys’ fees, costs and expenses: $180,540
  • Service award to class representative: $25,000
  • Payments to eligible class members: The remainder of the fund

When is the Hill v. TEP OPCO LLC, et al. payout date?

The settlement administrator will distribute payments after the court resolves all appeals and grants final approval to the settlement.

Why is there a class action settlement?

The lawsuit claims Tower Engineering Professionals Inc., TEP Opco LLC or TEPDB Opco LLC violated Washington law (RCW 49.58.110) by not disclosing wage scales or salary ranges in job postings and requesting applicants’ wage or salary histories.

The companies deny any wrongdoing or liability. Both sides agreed to settle to avoid the uncertainty, risks and expense of ongoing litigation and provide compensation to affected applicants sooner.
