Consumers who lived or worked in certain Northern California counties and paid any portion of health insurance premiums may qualify to claim a cash payment from a class action settlement.

Sutter Health agreed to pay $228.5 million to settle a class action lawsuit alleging violations of antitrust and unfair competition laws. The plaintiffs claim these violations resulted in higher insurance premiums for individuals and employers in Northern California.

Who is eligible for a Sutter Health payout?

Class members must meet the following criteria:

  • They paid any portion of a premium for a fully insured health insurance policy from:

    • Blue Shield of California
    • Health Net
    • United Healthcare
  • They paid these premiums at any time between Jan. 1, 2011, and March 8, 2021.
  • They paid these premiums, lived or worked in one of the following California counties:
    • Alameda

    • Butte
    • Calaveras
    • Colusa
    • Contra Costa
    • Del Norte
    • El Dorado
    • Glenn
    • Humboldt
    • Lake
    • Lassen

  • They did not opt out of the class action by the March 8, 2021, deadline.

Both individuals and employers can be class members. Employers qualify if they paid part of the premiums for their employees and had an office in one of the listed counties during the relevant period.

Only the person who paid the premiums is a class member, but claims may include the amount paid for family coverage.

How much is the health insurance premium payout?

Pro Rata Payment: The exact amount each person receives depends on the total amount of premiums they paid during the period and the number of valid claims submitted.

How to claim a Sutter Health class action rebate

To receive a payment, class members can file a claim online or download, print and complete the PDF claim form to mail to the settlement administrator. The claim deadline is Sept. 12, 2025.

Proof and documentation required

Most claimants do not need to provide documentation when submitting a claim. The claims administrator will use data from the health plans to estimate premiums paid.

However, claimants who wish to claim a higher percentage of premium contributions (for example, if they are an employee or employer who paid more than the default allocation), must provide supporting documentation for the amounts they claim, such as payroll records or premium statements.

Payout options

Class members can choose to receive their payment by:

  • Electronic debit card sent to the provided email address
  • Paper check mailed to the provided address

The $228,500,000 settlement fund covers:

  • Settlement administration costs: Amount not specified
  • Attorneys' fees: Up to $76,166,667
  • Attorneys' expenses: To be determined
  • Service awards to class representatives: Up to $20,000 for each of the three plaintiffs who testified at trial ($60,000 total) and $15,000 for each of the other three plaintiffs ($45,000 total)
  • Payments to class members: Remainder of the settlement fund

When is the health insurance premium settlement payout date?

Why was there a class action settlement?

The class action lawsuit alleged Sutter Health imposed certain pricing and contractual terms on health plans that violated state and federal antitrust and unfair competition laws.
