Southern Illinois Healthcare MyChart Class Action Settlement

Individuals who used the MyChart patient portal or completed a health risk assessment with Southern Illinois Healthcare Enterprises, Southern Illinois Hospital Services or Southern Illinois Medical Services NFP between Nov. 2, 2020, and July 6, 2023, may be eligible to submit a claim for a $17.50 cash payment and privacy protection services from a class action settlement. The settlement class includes an estimated 79,215 website visitors.

Southern Illinois Healthcare Enterprises Inc., Southern Illinois Hospital Services and Southern Illinois Medical Services NFP agreed to settle a class action lawsuit regarding their use of third-party tracking technologies, known as tracking pixels, on their web pages. The plaintiff claimed these tracking pixels violated certain privacy laws.

Who can file a MyChart claim?

Class members must meet one or more of the following criteria:

• They signed into the defendants’ MyChart patient portal or scheduled appointments through the MyChart patient portal or website open scheduling at anytime from
• Feb. 21, 2022, to Feb. 28, 2023, or
• June 12, 2023, to July 6, 2023

• They completed a health risk assessment at anytime from
• Nov. 2, 2020, to Jan. 31, 2021, or
• Feb. 1, 2021, to April 30, 2021

How much are settlement payments?

• Cash payment: Class members can submit a claim to receive a one-time cash payment of $17.50.
• CyEx Privacy Shield Pro: All class members can elect to enroll in one year of CyEx Privacy Shield Pro. Services include dark web and compromised password scanning, VPN, password manager and other online privacy tools, and access to fraud resolution agents if suspicious activity occurs. Class members do not need to submit claim form to receive this benefit.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to mail or email to the settlement administrator.

When is the Southern Illinois Healthcare pixel settlement payout date?

The settlement administrator will distribute payments to eligible class members approximately 30 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged Southern Illinois Healthcare Enterprises Inc., Southern Illinois Hospital Services and Southern Illinois Medical Services NFP used tracking pixels on their websites in a manner that violated certain privacy laws.

The defendants denied the allegations but agreed to settle to avoid the risk and expense of continued litigation and a possible trial.
