
Individuals who received notice that a February 2024 cybersecurity incident involving South Texas Oncology and Hematology PLLC may have impacted their private information could be eligible to claim up to $5,000 plus medical data monitoring from a class action settlement.
South Texas Oncology and Hematology PLLC agreed to pay $1.08 million to resolve a class action lawsuit alleging it failed to adequately protect personal information during the data breach.
Who can file a claim?
The settlement class includes all living individuals whose private information an unauthorized party may have accessed or acquired as a result of the Feb. 15, 2024, data incident involving South Texas Oncology and Hematology PLLC.
If an individual received a notification letter regarding this incident, they are likely included in the settlement class. The types of private information affected may include names, Social Security numbers and health information.
How much can class members get?
The settlement fund is $1,075,000. The amount each class member receives depends on the type of claim submitted and the total number of valid claims. The settlement administrator may adjust payments on a pro rata basis if the total amount claimed exceeds the available funds after deducting attorneys' fees, service awards and administrative costs.
- Cash Payment A – Documented losses: Class members can claim up to $5,000 for documented, unreimbursed losses related to the data incident. They must provide reasonable documentation, such as receipts, telephone records or email correspondence, showing the data breach caused the loss.
- Cash Payment B – Alternative cash: As an alternative to claiming documented losses, class members can choose a flat cash payment estimated at $100. This amount may increase or decrease depending on the number of valid claims submitted and the remaining funds after the administrator pays other expenses.
- Medical data monitoring: All claimants can also request two years of CyEx Medical Shield Complete, which includes credit monitoring, health care ID monitoring, dark web monitoring and $1,000,000 in identity theft insurance with no deductible.
How to claim a class action payment
Class members can file a claim online or download and print the PDF claim form, complete it and mail it to the settlement administrator. The claim deadline is July 6, 2026.

What proof or documentation is necessary to submit a claim?
- To submit an online claim, class members must provide the class member ID from the settlement notice they received.
- To submit a claim for cash payment A (documented losses), class members must provide reasonable documentation showing the data incident caused the loss. Acceptable documentation includes receipts, telephone records, correspondence (such as emails) or other third-party documents. Personal certifications or affidavits alone are not sufficient, but class members may include them for clarification.
- To submit a claim for cash payment B (alternative cash) or medical data monitoring, class members need only select the appropriate option.

- Eligible claimants who file by mail will receive a paper check sent to the address they provided on the claim form.

When is the South Texas Oncology and Hematology PLLC settlement payout date?
The settlement administrator will distribute the class member benefits no later than 75 days after the court grants final approval or 30 days after the settlement becomes effective, whichever is later.
