Who Are the Class Members?


Class Members include all persons within the United States who, from April 1, 2018, until August 25, 2023, purchased from Shutterfly's e-commerce website products at discounts from an advertised reference price and who have not received a refund or credit. This definition is designed to include a broad range of consumers who engaged with Shutterfly's e-commerce platform within the specified period.


Excluded from the Class is Shutterfly’s Counsel, its officers, directors, employees, and the judge presiding over the Action.


What Awards Can Class Members Claim?


Class Members who timely submit a valid Claim Form by the Response Deadline are entitled to one (1) Voucher for up to $25.00 toward any purchase at Shutterfly.com. Those who do not submit a Claim Form by the Response Deadline will automatically receive one (1) Direct Benefit Voucher for up to $5.00 toward any purchase at Shutterfly.com.


  • Voucher: $25.00 towards any purchase.
  • Direct Benefit Voucher: $5.00 towards any purchase.


Products or Services Subject to the Settlement


The settlement relates to the purchase of products at discounted prices from the advertised reference prices on Shutterfly's e-commerce website, Shutterfly.com, during the specified period.


Is Proof Required to Claim the Reward?


No but you must declare that declare that between April 1, 2018 and August 25, 2023, you made one or more purchases on Shutterfly.com in part because they were advertised as discounted from a reference price.


How to Claim Your Award


To claim the $25.00 Voucher, Class Members must complete and submit a Claim Form, which can be done electronically or by postal mail. The Claim Form must be submitted by February 5, 2024. For those who do nothing, a $5.00 Direct Benefit Voucher will be provided automatically if the Court approves the Settlement. Detailed instructions and the Claim Form are available at https://rivalishutterfly.claims-administrator.com/.


Analysis of the Settlement Amount


Shutterfly has agreed to provide Vouchers as part of the settlement agreement, which includes $25.00 Vouchers to eligible Class Members who file a claim and $5.00 Direct Benefit Vouchers to those who do not file but are eligible.


Why Is There a Class Action Settlement?


This Settlement resolves a lawsuit where the Named Plaintiff alleged that Shutterfly engaged in deceptive advertising by advertising improper discounts on merchandise. Shutterfly denies all allegations of wrongdoing and any liability. The Settlement has been reached to avoid the costs and risks of a trial and to provide immediate benefits to Class Members.
