Current and former employees who worked for Swire Coca-Cola USA in Washington state and earned less than twice the state minimum hourly wage between Sept. 9, 2022, and March 10, 2026, may be eligible to receive an estimated payment of $672.54 from a class action settlement. The settlement class includes approximately 2,003 individuals.

Swire Pacific Holdings Inc., d/b/a Swire Coca-Cola USA and now known as Swire Coca-Cola USA Inc., agreed to pay $2 million to settle a class action lawsuit alleging it entered into noncompetition covenants with certain employees in violation of Washington law. The plaintiff claimed the company’s employment policies unlawfully restricted employees from working other jobs or engaging in additional work during their employment.

Who are the class members?

Class members must meet the following criteria:

  • They worked for Swire Coca-Cola USA in the state of Washington at any time between Sept. 9, 2022, and March 10, 2026.
  • They earned less than twice the applicable state minimum hourly wage during qualifying time period.

How much are settlement payments?

Pro rata cash payment: Eligible class members will receive a pro rata cash payment from the net settlement fund estimated at $672.54.

No claim form required

Class members do not need to file a claim to receive a settlement payment.

To receive a digital payment, class members can submit a payment selection form online using the login ID and PIN from their settlement notice. They can also submit an address update using the same link.

The payment selection and address update deadline is Nov. 2, 2026.

Settlement fund breakdown

The $2,003,000 settlement fund will include:

  • Settlement administration costs: Up to $25,000
  • Attorneys’ fees: $600,900
  • Attorneys’ expenses: Up to $10,000
  • Service awards to class representatives: $20,000 each ($40,000 total)
  • Payments to eligible class members: Remaining settlement funds

Important dates

  • Opt-out deadline: Nov. 2, 2026
  • Final approval hearing: Nov. 13, 2026

When is the Swire Coca Cola employee settlement payout date?

The settlement administrator will issue payments to eligible class members approximately 60 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

This class action settlement resolves claims that Swire Pacific Holdings Inc., d/b/a Swire Coca Cola USA, allegedly violated Washington law by entering into noncompetition covenants with employees who earned less than twice the state minimum wage. The plaintiffs alleged the company’s policies unlawfully restricted employees from working other jobs or engaging in additional paid work.
