Employees who worked at the Aqueduct Buffet at Resorts World Casino New York City and whom the company terminated around Jan. 6, 2014, may be eligible to claim a cash payment ranging from $557.29-$8,861.72 from a class action settlement.

Genting New York LLC, doing business as Resorts World Casino New York City, agreed to pay $1,124,217.46 to settle a class action lawsuit alleging it violated the federal and New York Worker Adjustment and Retraining Notification acts by failing to provide legally required advance notice to employees before closing the Aqueduct Buffet.

Who can file a claim?

The class consists of individuals who meet all of the following criteria:

  • Resorts World Casino New York City employed them.
  • They worked at the Aqueduct Buffet.
  • Resorts World Casino New York City terminated them on or about Jan. 6, 2014, because it closed the Aqueduct Buffet.
  • Schedule 1 of the settlement agreement (beginning on Page 12) specifically names them (the list includes 176 individuals).

The class includes both hourly and salaried employees regardless of position and hours worked as long as Schedule 1 lists them. If a class member is deceased, their estate may file a claim and receive the payment provided it submits appropriate documentation.

How much is the Aqueduct Buffet payout?

The total settlement fund is $1,124,217.46. After deducting attorneys’ fees, litigation expenses, settlement administration costs and incentive awards to the class representatives, the settlement administrator will distribute the remaining amount, at least $697,087.89, to class members who submit valid and timely claims.

The amount each class member receives is based on their calculated damages as detailed in Schedule 1 of the settlement agreement (beginning on Page 12). Counsel determined each class member’s share by dividing their individual damages by the total damages for all class members then multiplying that percentage by the net settlement fund.

  • The lowest expected payout is $557.29.
  • The highest expected payout is $8,861.72.
  • Most payouts fall between $2,000 and $5,000.

If the court approves less than the requested fees or awards, the settlement administrator will redistribute the extra funds proportionally among class members. If any funds remain after all payments and it is not feasible to distribute them further, the administrator may donate them to the Boys and Girls Club of America.

How to claim a settlement payout

Class members must download, print and complete the PDF claim form and mail, email or fax it to the settlement administrator. There is no online claim portal. The final deadline to submit a claim is Jan. 15, 2026.

Those filing on behalf of a deceased class member’s estate must include proof that they are the executor.

Payout options

The settlement administrator will issue payments by check to the address class members provided on the claim form. Checks expire 90 days after issuance.

$1.12 million settlement fund breakdown

The $1,124,217.46 settlement fund covers:

  • Settlement administration costs: Up to $25,000
  • Attorneys’ fees: $353,254.11
  • Attorneys’ expenses: $8,875.46
  • Incentive awards to class representatives: $40,000 ($10,000 each to four representatives)
  • Payments to eligible class members: At least $697,087.89 (the remainder after deductions)

  • Opt-out deadline: 60 days from the date of the class notice mailing

When is the Resorts World WARN Act settlement payout date?

The settlement administrator will mail payments approximately 30 days after the court grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Resorts World Casino New York City failed to provide required advance notice to employees before closing the Aqueduct Buffet as mandated by the federal and New York WARN acts.

The company denies any wrongdoing but agreed to settle to avoid the costs, risks and delays of further litigation. The settlement provides compensation to affected workers without admitting liability.
