Refresco Beverages $4.27 Million Job Applicant Settlement

Employment seekers who applied for a job with Refresco Beverages US Inc. in Washington state between Jan. 1, 2023, and June 5, 2026, may be eligible to claim a cash payment from a class action settlement.

Refresco Beverages US Inc. agreed to pay between $2.79 million and $4.27 million to resolve a class action lawsuit alleging its job postings for Washington-based positions failed to include required wage and benefits information as mandated by Washington’s pay transparency law.

Who can file a claim?

Individuals must meet all of the following criteria:

  • They applied for a job opening with Refresco Beverages US Inc. for a position the hired employee would perform in the state of Washington.
  • They submitted an application between Jan. 1, 2023, and the June 5, 2026.
  • The job posting they responded to did not include the wage scale or salary range and/or a general description of benefits for the position.

Class members may have applied electronically or by hard opy directly to Refresco or through a third party.

The settlement administrator will use Refresco’s records to verify eligibility and may ask claimants to provide additional information if necessary.

How much is the Refresco Beverages payout?

The amount each class member receives depends on how many valid claims class members submitted. The total settlement fund ranges from a minimum of $2,794,079.67 to a maximum of $4,265,000.

All participating class members who submit a valid claim will receive an equal share of the net settlement fund, which is the total settlement fund minus attorneys’ fees and costs, the service award to the class representative and settlement administration costs.

  • If 853 or fewer class members (50% or fewer of the 1,706 total) submit valid claims, the settlement administrator will distribute the minimum fund of $2,794,079.67 equally among claimants.
  • For every additional participating class member above 853, Refresco will increase the settlement fund increases by $1,724.39 up to the maximum settlement fund of $4,265,000.

The settlement administrator considers payments nonwage statutory damages and will report them on IRS Form 1099.

How to claim an award

Class member can file a claim online or download a personalized claim form from the same link, print it, complete it and mail or email it to the settlement administrator.

The claim deadline is Sept. 14, 2026. Class members who wish to avoid initial tax withholdings may also submit an IRS Form W-9. If claimants do not submit a W-9, initial tax withholdings may apply to the settlement payment.

Required proof

To file an online claim, class members must use the unique ID and PIN provided in the settlement notice they received.

Payout options

The settlement administrator will mail checks to the address the claimant provides. Class members must cash checks within 180 days of issuance

The settlement fund of up to $4,265,000 will include:

  • Settlement administration costs: Up to $40,000
  • Attorneys’ fees: $1,258,175
  • Attorneys’ expenses: $5,000
  • Service award to class representative: $20,000
  • Payments to eligible class members: Remaining settlement funds
