Current and former employees who received notice in or around November 2023 that a data breach involving Refresco Beverages US Inc. may have compromised their personal information could qualify to submit a claim for up to $5,000 from a class action settlement.

Refresco Beverages US Inc. agreed to pay $650,000 to settle a class action lawsuit alleging it failed to adequately safeguard sensitive personal information. The data breach, which occurred in March 2023, potentially exposed names, dates of birth, Social Security numbers, addresses, financial account numbers, driver’s license numbers, health insurance policy numbers and certain health information connected to workers’ compensation and Americans with Disabilities Act accommodations proceedings.

Who is eligible for a data breach payout?

Class members must meet the following criteria:

  • They received a notice letter in or around November 2023 from Refresco Beverages US Inc. notifying them that the March 2023 data breach potentially compromised their private information.
  • Their name is on the list of individuals Refresco identified as impacted by the incident.

How much is the class action settlement payment?

Class members can claim one or more of the following:

  • Out-of-pocket expenses: Claimants can submit a claim to receive up to $500 for documented expenses reasonably traceable to the data breach. This may include unreimbursed bank fees, interest on short-term loans, postage, gasoline for local travel, and costs for credit reports, credit freezes or credit monitoring purchased after the incident.
  • Attested time spent: Class members can also claim up to five hours of compensation for time spent dealing with issues related to the incident at $20 per hour for a maximum of $100.
  • Documented extraordinary loss payment: Class members can submit a claim to receive up to $5,000 for actual, documented and unreimbursed monetary losses due to identity theft or fraud that the data breach most likely caused. Losses must have occurred between March 2023 and Dec. 4, 2025, and include only losses or expenses not covered by other reimbursement categories.

How to claim a class action rebate

To claim a settlement payment, class members must submit a claim form by the Dec. 4, 2025, deadline. There are two ways to do this:

Required proof and claim information

  • To submit a claim online or by mail, class members must provide the notice ID and PIN from their official settlement notice.
  • Out-of-pocket expenses claims must include documentation, such as receipts or bank and credit card statements, showing the expense and its connection to the data breach.
  • Extraordinary loss claims must include proof, such as police reports, invoices for accountant or attorney services, proof of falsified tax returns or loans and other documentation showing fraudulent charges traceable to the incident.

$650,000 data breach settlement fund

The settlement fund of $650,000 will include:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $216,666.67
  • Attorneys' costs and expenses: Approximately $13,650.75
  • Payments to approved claimants: Remaining settlement funds

  • Opt-out deadline: Nov. 4, 2025
  • Claim deadline: Dec. 4, 2025
  • Final approval hearing: Dec. 16, 2025

When is the Refresco Beverages data breach settlement payout date?

The settlement administrator will issue payments to eligible claimants approximately 120 days after it completes claim processing or the court grants final approval of the settlement, whichever is later.

Why did this settlement happen?

The class action lawsuit alleged an unauthorized party accessed Refresco Beverages US Inc.'s computer network in March 2023, potentially exposing sensitive personal information. The plaintiff claimed Refresco failed to adequately protect this information.

Refresco denies any wrongdoing but agreed to settle to avoid the uncertainty and expense of continued litigation.
