Employees who worked as tipped staff at Pineda Inn Bar & Grill between April 2021 and August 2023 and had a tip credit applied to their hourly wage may be eligible to claim $2 per hour for non-tipped work from a class action settlement.

IR Tiki LLC, d/b/a Pineda Inn Bar & Grill, agreed to pay $120,000 to settle a class action lawsuit alleging it failed to pay tipped staff the minimum wage required by the Florida Minimum Wage Act when it applied tip credit to their hourly wage.

Who can file a claim?

To be eligible for this settlement, individuals must meet all of the following criteria:

  • They worked as tipped staff at Pineda Inn Bar & Grill.
  • Pineda applied a “tip credit” to their hourly wage.
  • Pineda employed them at any time from April 2021 through August 2023.
  • Pineda did not pay them the minimum wage compensation as required by the Florida Minimum Wage Act.

If an individual received a notice about this settlement, it means the defendant’s records indicate they may be a class member.

How much can class members receive?

Eligible class members who submit a valid claim can receive $2 per hour for each hour of non-tipped work they performed during the class period (April 2021-August 2023) in which Pineda Inn Bar & Grill applied a tip credit and did not pay them minimum wage.

There is no minimum or maximum per person, but the settlement caps the fund for all class member payments at $120,000. If the amount class members claim exceeds the fund, the settlement administrator will adjust payments on a pro rata basis. The settlement also allows for an increase in the fund if the administrator identifies more than 81 class members with a 5% increase for each additional member above 81.
