Peco Foods $950,000 Data Breach Class Action Settlement

Individuals who received a notice from Peco Foods about a data breach that occurred in December 2023 may be eligible to submit a claim for up to $6,550 from a class action settlement. The cybersecurity incident compromised approximately 46,442 people.

Peco Foods Inc. agreed to pay $950,000 to settle a class action lawsuit alleging an unauthorized third party accessed the personal identifiable information of certain individuals.

Who can file a claim for a data breach payout?

Class members are individuals residing in the United States who received written notice that their personally identifiable information may have been compromised in the Peco Foods data breach that occurred on or around Dec. 4, 2023.

How much are settlement payments?

Class members have the following benefit options

• Ordinary out-of-pocket losses: Class members can claim up to $1,000 for documented, unreimbursed expenses resulting from the data breach. This includes costs for credit monitoring, fees for freezing or unfreezing credit reports, late fees, overdraft fees, card replacement fees, unauthorized charges not reimbursed, postage and transportation expenses related to addressing the breach.
• Extraordinary losses and attested time: Class members can claim up to $5,000 for documented, unreimbursed losses due to identity theft, fraud or other extraordinary losses. This includes monetary losses caused by identity theft or fraud traceable to the data breach and not previously reimbursed.
• Class members can also claim up to 10 hours at $40 per hour for time spent remedying issues related to the breach. This is included within the extraordinary losses $5,000 cap.

• Credit monitoring services: All class members can elect to receive three years of three-bureau credit monitoring. Services include dark web scanning, public record monitoring and access to fraud resolution agents.
• Residual cash payment: All class members can submit a claim to receive a residual cash payment of up to $550 from the remaining net settlement fund. The settlement administrator will determine the final payment amount by the total number of claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form and mail it to the settlement administrator.

Required proof and claim information

• To submit a claim online, claimants must provide the claim ID from the settlement notice they received.
• To submit a claim for ordinary out-of-pocket losses, claimants must provide supporting documentation, such as receipts, bank statements or other proof of expenses.
• To submit a claim for extraordinary losses, claimants must provide supporting documentation showing monetary losses from identity theft or fraud and related expenses.
• To submit a claim for attested time, claimants must provide a description of the actions they took and the time spent responding to the data breach.

When is the Peco Foods data breach settlement payout date?
