Individuals who received notice that the June 2024 data breach involving Oliver Street Dermatology Management LLC may have affected their private information could be eligible to claim up to $4,080 from a class action settlement.

Oliver Street Dermatology Management LLC, which operates as U.S. Dermatology Partners, agreed to resolve a class action lawsuit alleging an unauthorized criminal third party accessed its network in June 2024. The incident may have exposed files containing personal information, including names, dates of birth, medical record numbers, health insurance details, medical record information and Social Security numbers.

Who can file a claim?

Individuals are eligible to file a claim if they meet the following criteria:

  • They received notice of the June 2024 data incident from Oliver Street Dermatology Management LLC, including notice of this settlement.
  • The data incident potentially impacted their private information.

How much can class members receive?

  • Documented out-of-pocket losses: Class members may claim one of the following loss categories:
    • Ordinary documented losses: Class members may claim up to $400 for actual, documented and unreimbursed out-of-pocket expenses related to the data incident. Eligible expenses include costs for freezing or unfreezing credit, credit monitoring purchased after the incident and miscellaneous costs, such as postage, copying or notary fees. Documentation, such as receipts, is required. OR
    • Identity fraud losses: Class members may claim up to $4,000 for money lost due to fraud or identity theft related to the data incident. Documentation must show the loss, that a third party did not reimburse it and that it occurred after June 19, 2024.
  • Lost time: Class members who spent time responding to the data incident may claim up to four hours of lost time at $20 per hour for a maximum of $80.
  • Credit monitoring: All class members can claim two years of credit monitoring from one credit bureau. This service includes $1 million in identity theft insurance, real-time credit file monitoring, dark web scanning and public records monitoring. If suspicious activity is detected, a fraud resolution agent is available to assist.

How to claim a U.S. Dermatology Partners payment

Class members can file the online claim form or download, print and complete the PDF claim form to mail to the settlement administrator. The claim deadline is Feb. 17, 2026.

What proof or documentation is required to submit a claim?

  • To submit an online claim form, class members must log in with the unique ID and PIN located on the postcard settlement notice they received.
  • To submit a claim for credit monitoring and lost time, class members must attest to their eligibility and describe the activities they performed in response to the data incident.
  • For documented loss claims, class members must provide receipts or other documentation showing the amount spent or lost. Personal certifications or affidavits alone are not sufficient, but class members can include them to provide context for the documentation.

Payout options

  • Class members who file a claim by mail will receive a paper check.
  • Class members who file a claim online may select a digital payment option.

Settlement fund breakdown

The settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: Up to $150,000
  • Service award to class representative: Up to $1,500
  • Payments to eligible class members: Value of credit monitoring, lost time and documented losses

When is the Olson v. Oliver Street Dermatology Management LLC payout date?

The settlement administrator will distribute payments approximately 45-75 days after the court resolves any appeals and grants final approval to the settlement.

The class action lawsuit alleged a criminal third party accessed Oliver Street Dermatology Management’s network in June 2024, potentially exposing sensitive personal information. The plaintiff claimed OSDM failed to protect private information.
