
Individuals who received a notice that the January 2025 Olinsky and Associates data breach may have compromised their personal information could be eligible to receive a $40 cash payment and three years of credit monitoring from a class action settlement.
Olinsky & Associates PLLC agreed to settle a class action lawsuit alleging the firm failed to adequately protect sensitive personal and health information during a cyberattack.
Who are the class members?
Class members are individuals whom Olinsky & Associates identified as impacted by the January 2025 data breach, including those who received notice of the incident.
How much are settlement payments?
Eligible class members will receive the following benefits:
- Cash payments: All eligible class members will receive a cash payment of $40.
- Credit monitoring: All class members will receive an activation code for three free years of CyEx Financial Shield Complete. This includes one-bureau credit monitoring, bank and financial account monitoring, transaction monitoring with real-time authentication alerts and access to a fraud resolution agent if needed.
No claim form required
Class members do not need to file a claim to receive their settlement benefits:
- Cash payment: Class members can submit an address update and/or a payment election form online using the LoginID and PIN from their settlement notice.
- Credit monitoring services: Class members can also submit a request online to receive an email notification with instructions when CyEx Financial Shield Complete activation code is available.
Class members must submit the payment election form by Dec. 2, 2026, to receive an electronic payment.

When is the Olinsky and Associates data breach settlement payout date?
The settlement administrator will issue payments approximately 60 days after the court grants final approval of the settlement.
Why is there a class action settlement?
This class action lawsuit alleged Olinsky & Associates PLLC failed to adequately protect personal and health information during a cyberattack in January 2025. The plaintiffs claimed Olinsky was negligent, breached implied contracts and received unjust enrichment by not safeguarding client data.
Olinsky denies the allegations but agreed to settle to avoid the expense and risk of continued litigation.
