Night US, Brooklyn Bedding $8.16M Class Action Settlement

Consumers who purchased one or more mattresses advertised at a discount from leesa.com, brooklynbedding.com, helixsleep.com or bearmattress.com during specific periods may be eligible to claim $110 per mattress from a class action settlement.

Night US LLC and Brooklyn Bedding LLC agreed to pay $8,163,000 to settle a class action lawsuit alleging they deceptively advertised discounts on mattresses sold through their websites.

Who can file a claim?

To be eligible to file a claim, Individuals must meet all of the following criteria:

• They purchased one or more mattresses that leesa.com, brooklynbedding.com, helixsleep.com or bearmattress.com advertised at a discount.
• They purchased the mattress while physically present in California or as a resident of California.
• The purchase occurred during the following time frames:
• Leesa.com: July 28, 2019, to March 11, 2024
• Brooklynbedding.com: Sept. 5, 2020, to March 31, 2024
• Helixsleep.com: Oct. 2, 2020, to March 31, 2024
• Bearmattress.com: June 4, 2021, to April 1, 2024

Individuals who placed multiple qualifying orders can submit a claim for each one.

How much can class members receive?

Class members who submit a valid claim are eligible to receive $110 for every qualifying mattress order they placed during the relevant time periods. Qualifying class members who submit a valid claim form will receive a cash payment via check or electronic payment. Qualifying class members who do not submit a claim form will automatically receive a $110 store credit voucher per qualifying mattress order.

Class members can use the vouchers for any purchase on the applicable website, including taxes, shipping and handling fees. They are stackable, transferable and combinable with other discount or sales. Vouchers are valid for three years from the date of issuance.

How to claim a class action payment

Class members who wish to receive a cash payment can file a claim online or download and print a PDF claim form, complete it and mail it to the settlement administrator. The claim deadline is Sept. 25, 2026.

Class members who do not submit a claim form will automatically receive a store credit voucher for each qualifying mattress order.

$8.16 million settlement fund breakdown

The $8,163,000 settlement fund covers:

• Settlement administration costs: Up to $40,000
• Attorneys’ fees and expenses: Up to $1,900,000
• Service awards to class representatives: $5,000 for each plaintiff ($20,000 total)
• Payments to eligible class members: Approximately $8,163,000

The payment of administration costs, attorneys’ fees and service awards will not reduce the value of the awards to class members.

When is the Grossman et al. v. Night US LLC and Brooklyn Bedding LLC payout date?

The settlement administrator will distribute payments after the court resolves any appeals and grants final approval.

Why is there a class action settlement?

The class action lawsuit alleges Night US and Brooklyn Bedding deceptively advertised discounts on their websites in violation of California consumer protection laws. The claims also included breach of contract, breach of express warranty, quasi-contract/unjust enrichment and intentional and negligent misrepresentation.

The defendants deny all allegations but agreed to settle to avoid the costs and risks of further litigation.
