If you received notice that your personal or private health information was affected by a cyberattack on New Horizons Medical, Inc. in early 2023, you may be eligible to submit a claim for up to $2,000 from a class action settlement.

New Horizons Medical, Inc. has agreed to pay to settle a class action lawsuit that alleged the company failed to adequately protect individuals’ private information, resulting in a cyberattack.

Who is eligible for a data breach payout?

Class members must meet the following criteria:

  • Their personally identifiable information (PII) and/or private health information (PHI) was impacted by the cyberattack on New Horizons Medical, Inc., which was announced on or about June 16, 2023.
  • They received a notice from New Horizons Medical, Inc. indicating that their information may have been compromised in the incident.

How much is the class action settlement payment?

Claimants have the following benefit options:

  • Reimbursement for Ordinary Losses: Class members can submit to receive up to $250 per claimant for out-of-pocket expenses or lost time related to the incident.
    • Out-of-pocket expenses may include bank fees, credit monitoring or identity theft insurance fees and postage.
    • Lost time can be claims for up to four hours at $30 per hour.
  • Reimbursement for Extraordinary Losses: Class members can submit to for up to $2,000 per claimant for documented monetary losses traceable to the data incident.
    • Monetary losses include may include attorneys’ fees, accountants’ fees, or fees for credit repair services for losses that occurred between February 12, 2023 and July 13, 2025.
  • Credit Monitoring Extension: Settlement class members who enrolled in the free Experian IdentityWorksSM Credit 3B services offered by New Horizons Medical will receive an additional 12 months of coverage, regardless of whether they make a claim for monetary compensation.

How to claim a data breach class action rebate

To receive a settlement payment, class members must submit a claim form. Class members can file a claim online or print the PDF claim form to complete and mail it to the settlement administrator.

All claim forms must be submitted online or postmarked by the deadline of July 13, 2025.

Required proof and information

  • Class Member ID from settlement notice required to submit a claim online or by mail.
  • Ordinary losses claims require receipts, bills, or statements showing the expense was incurred as a result of the incident.
  • Extraordinary losses claims require documentation that the loss was actual, unreimbursed, and more likely than not caused by the incident.

New Horizons Medical settlement fund

The settlement fund includes:

  • Settlement administration costs: No more than $63,99
  • Attorneys' fees and costs: Up to $215,000
  • Service award to class representative: $2,000
  • Credit monitoring and identity theft protection services: Cost determined by the number of class members that opt in
  • Payments to approved claimants: Cost determined by the number of valid claims submitted

When is the New Horizons Medical settlement payout date?

Payments will be issued to eligible class members 60 days after the court grants final approval or upon the completion of claim review.
