Menasha Packaging $1.73M Wage and Hour Class Action Settlement

Individuals who worked as hourly, nonexempt employees for Menasha Packaging Co. LLC and Menasha Corp. or whom Simplified Labor Staffing Solutions Inc. or another staffing agency in California assigned to work at Menasha between Jan. 15, 2017, and Sept. 15, 2024, may be eligible to claim a cash payment from a class action settlement.

Menasha Packaging, Menasha Corp. and Simplified Labor Staffing Solutions agreed to pay $1,732,500 to settle alleged wage-and-hour violations, including claims of unpaid wages, missed meal and rest breaks, unreimbursed work expenses, inadequate workplace conditions and failure to provide accurate wage statements.

Who are the class members?

Class members are individuals whom Menasha Packaging or Menasha Corp. employed in California as hourly, nonexempt employees at any time between Jan. 15, 2017, and Sept. 15, 2024, or whom Simplified Labor Staffing Solutions or another temporary staffing agency assigned to work at Menasha Packaging Co. or Menasha Corp. during the same period. The settlement administrator will base eligibility on employment records maintained by Menasha and the relevant staffing agencies.

There are two main groups within the class:

  • Class members: Hourly, nonexempt employees who worked at Menasha in California from Jan. 15, 2017, to Sept. 15, 2024
  • Aggrieved employees: Hourly, nonexempt employees who worked during the Private Attorneys General Act period from July 31, 2018, to Sept. 15, 2024

How much can class members receive?

The amount each class member receives depends on the number of workweeks they worked during the relevant periods and whether they are eligible for both the class payment and the PAGA payment. There are two main payment categories:

  • Individual class payment: Based on the number of workweeks worked during the class period
  • Individual PAGA payment: Based on the number of workweeks worked during the PAGA period

After deductions for attorneys’ fees and costs, service awards, administration costs and PAGA penalties, the settlement administrator will split the net settlement fund as follows:

  • 80% to those who worked from Jan. 15, 2017, to Jan. 16, 2022, (the rounding period) and were subject to the companies’ rounding practices
  • 20% to those who worked during the non-rounding period of Jan. 17, 2022, to Sept. 15, 2024

Aggrieved employees receive a share of the $18,750 PAGA fund based on PAGA-period workweeks.

No action needed to receive payment

Class members do not need to file a claim to receive their payment. Eligible class members will automatically receive a check at their last known address. Class members who moved should notify the settlement administrator to ensure they receive payment.

Class members who believe the number of workweeks credited to them is incorrect may submit pay stubs or other records to challenge the calculation. The deadline to submit these documents is Nov. 21, 2026.

Why is there a class action settlement?

The class action lawsuit claimed Menasha Packaging, Menasha Corp. and Simplified Labor Staffing Solutions violated California labor laws. The alleged violations include unpaid overtime and minimum wages, missed meal and rest breaks, unreimbursed business expenses, late wage payments, inaccurate wage statements and inadequate workplace facilities.

The companies denied any wrongdoing but agreed to settle to avoid the costs and risks of continued litigation.
