Undergraduate students whom Le Moyne College charged tuition and/or mandatory fees and who enrolled in at least one in-person, on-campus class during the spring 2020 semester may be eligible to claim a cash payment from a class action settlement.
Le Moyne College agreed to pay $243,206 to settle a class action lawsuit alleging breach of contract and unjust enrichment related to the college’s transition to remote learning and services during the COVID-19 pandemic in spring 2020.
Who are the class members?
Class members must meet the following criteria:
- They enrolled as an undergraduate student at Le Moyne College during the spring 2020 semester.
- Le Moyne charged them tuition and/or mandatory comprehensive fees and academic and incidental fees.
- They enrolled in at least one in-person, on-campus class during the spring 2020 semester.
- They remained enrolled as of March 1, 2020.
If an individual received a notice about this settlement, Le Moyne’s records indicate they are a member of the class. The settlement administrator used the college’s enrollment and billing records to identify eligible class members so most eligible students should have received notification.
How much can class members receive?
Each eligible class member who does not opt out will receive an equal share of the net settlement fund, which is the total settlement amount minus attorneys’ fees, litigation costs, service awards and administration costs.
No action needed to receive compensation
Eligible class members do not need to file a claim to receive their payment. They will automatically receive their share of the settlement after the court grants final approval to the settlement.
Class members can choose how they want to receive payment. To select an electronic payment method (such as Venmo or PayPal), they must submit an election form online or return the PDF election form by mail, fax or email to the settlement administrator. They may also return the election form included with their notice. The deadline to return the election form is Oct. 19, 2026. Those who do not submit the form will receive a physical check mailed to the address on file.

The $243,206 settlement fund will cover:
- Settlement administration costs: Up to $24,990
- Attorneys’ fees: Up to $81,068.66
- Attorneys’ expenses: Up to $20,000
- Service award to class representative: Up to $2,500
- Payments to eligible class members: The remainder of the fund

When is the Germakovski v. Le Moyne College payout date?

Why did this class action settlement happen?
The class action lawsuit alleged Le Moyne College breached its contract and received unjust enrichment when it moved in-person classes and services online during the COVID-19 pandemic in spring 2020. The plaintiffs claimed they were entitled to a pro-rated refund of tuition and fees for the period when the college did not provide in-person services.
Le Moyne denied all allegations but agreed to settle to avoid the expense and uncertainty of continued litigation.
