Individuals whose personal or health information the January 2024 data breach at Lakeview Health Systems compromised may be eligible to submit a claim for up to $7,080 from a class action settlement.

Lakeview Health Systems LLC agreed to settle a class action lawsuit alleging a targeted cyberattack exposed sensitive personal and health information, including names, addresses, Social Security numbers, medical records and other private data.

Who can file a claim for a data breach payout?

Class members are individuals residing in the United States whose personally identifiable or protected health information he data incident discovered by Lakeview Health on or around Jan. 25, 2024, compromised.

How much are settlement payments?

  • Ordinary losses (out-of-pocket expenses): Class members can claim up to $2,000 for documented out-of-pocket expenses incurred between Jan. 25, 2024, and Aug. 24, 2026, as a result of the data breach. This includes fees for credit reports, credit monitoring or freezing/unfreezing credit, costs to replace IDs and postage for communicating with financial institutions.
  • Extraordinary losses (identity theft or fraud): Class members can claim up to $5,000 in documented monetary losses that occurred due to identity theft or fraud likely caused by the breach. Ordinary losses must not already cover the losses, they must have occurred between Jan. 25, 2024, and Aug. 24, 2026, and the claimant must show they attempted to recover the loss.
  • Lost time: Class members can claim up to four hours of time spent responding to the data breach at $20 per hour for a maximum of $80. This includes time spent researching the data breach, changing passwords and investigating suspicious activity.
  • Alternative cash payment: Class members who do not submit a claim for credit monitoring, ordinary losses, extraordinary losses or lost time can submit a claim to receive a one-time cash payment estimated at $50. The settlement administrator will determine the final payment amount by the total number of claims filed.
  • Credit monitoring: All class members can elect to receive one year of CyEx Medical Shield Total. Services, including $1 million in medical identity theft insurance, monitoring for health care insurance ID exposure, medical record number exposure and unauthorized Health Savings Account spending and access to fraud resolution agents.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail or email to the settlement administrator.

Required proof and claim information

  • All claimants must provide the unique ID from the settlement notice they received. Online claimants must also provide the PIN from the same notice.
  • Ordinary losses claims require supporting documentation, which may include receipts, invoices or bank or credit card statements showing the fees paid.
  • Extraordinary losses claims require supporting documentation showing monetary losses and efforts to recover them.
  • Lost time claims require a brief description of the time spent.

Settlement fund breakdown

When is the Lakeview Health Systems settlement payout date?

The settlement administrator will issue payments after it completes claim processing or approximately 90 days after the court grants final approval of the settlement, whichever is later.

Why did this class action settlement happen?

This class action lawsuit alleged a targeted cyberattack on Lakeview Health’s computer systems in January 2024 exposed sensitive personal and health information. The plaintiffs claimed Lakeview Health failed to adequately protect current and former patients.

Lakeview Health the allegations but agreed to settle to avoid the costs and uncertainty of continued litigation.
