JustPlay $4.5 Million BIPA Class Action Settlement

Illinois residents who used the JustPlay app and whom the company collected or processed biometric data, such as a facial images, videos or photographs, from without their written consent since Oct. 24, 2019, may be eligible to submit a claim for $15 from a class action settlement.

JustPlay GMBH, doing business as JustPlay, and Gimica GMBH, doing business as Gimica Games, agreed to pay $4.5 million to settle a class action lawsuit alleging they improperly collected, stored and used biometric information from Illinois mobile app users n violation of the Illinois Biometric Information Privacy Act.

Who can file a claim for a class action payment?

Class members include living Illinois residents whose biometric data the JustPlay mobile application collected, captured, possessed, used, transmitted, disseminated, stored or otherwise obtained without prior written consent at any time since Oct. 24, 2019.

How much is the settlement payout?

Cash payment: Class members can submit a claim to receive a one-time $15 cash payment. The settlement administrator may reduce the payment amount on a pro rata basis if the number of valid claims exceed the settlement amount.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or download and print the PDF claim form to mail to the settlement administrator.

Class members must submit their claim online or postmark it by March 16, 2026.

$4.5 million JustPlay settlement fund

The $4,500,000 settlement fund will include:

• Settlement administration costs: To be determined
• Attorneys' fees and costs: $1,687,500
• Service award to class representative: Up to $2,000
• Payments to approved claimants: Remaining settlement funds

Important dates

• Deadline to opt out: March 2, 2026
• Deadline to file a claim: March 16, 2026
• Final approval hearing: March 31, 2026

When is the JustPlay BIPA settlement payout date?

The settlement administrator will issue payments to eligible class members approximately 60 days after the court grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit claimed JustPlay collected, stored and used biometric information from users of its mobile app without obtaining prior written consent, which is required by the Illinois Biometric Information Privacy Act.

JustPlay denies any wrongdoing, however agreed to settle to avoid the expense and risk of continued litigation.
