Indegene $4.7M TCPA Class Action Settlement

Individuals and entities who received a fax on or about Feb. 7, 2020, offering a $250 honorarium for a medical record review related to anti-Parkinson’s disease medications, may be eligible to submit claim for up to $250 from a class action settlement. Approximately 18,869 advertising faxes were sent.

Indegene Inc., along with its affiliates Indegene Encima Inc., Indegene Wincere Incorporated, and Indegene Healthcare LLC, has agreed to pay $4,717,250 to settle a class action lawsuit. The complaint alleges that these companies sent unsolicited fax advertisements in violation of the federal Telephone Consumer Protection Act (TCPA).

Who can file a claim for a TCPA payout?

Class members must meet the following criteria:

• They were successfully sent a fax on or about Feb. 7, 2020.
• The fax was titled “Medical Record Review of the Impact of Adverse Events Associated with the Use of Current anti-Parkinson’s Disease Medications on Patient Clinical Therapeutics and Outcomes Trajectories in the U.S.”
• The fax offered an honorarium of $250 per eligible patient.

How much are settlement payments?

Pro rata cash payment: Class members can submit a claim to receive a pro rata cash payment of up to $250. The final payment will be determined by the total number of claims filed.

How to claim a class action rebate

To receive a settlement payment, class members can file a claim online or print and complete the PDF claim form, and mail or fax it to the settlement administrator.

Settlement fund breakdown

The $4,717,250 settlement fund will include:

• Class representative incentive award: Up to $15,000
• Payments to eligible class members: Remaining settlement funds up to $250 per approved claim

When is the Progressive Health and Rehab Corp. v. Indegene Inc. et al. payout date?

Payments will be mailed to approved claimants after the court grants final approval of the settlement.
