Individuals who received a notice that their private information may have been impacted by a September 2024 data breach involving Healthcare Services Group could qualify to claim up to $5,000 plus a pro rata payment and credit monitoring from a class action settlement. The cyberattack compromised approximately 624,496 people.

Healthcare Services Group Inc. agreed to pay $3 million to settle a class action lawsuit alleging negligence, breach of contract, unjust enrichment and violations of consumer protection laws after a cybersecurity incident potentially exposed sensitive personal information of current and former employees and others.

Who can file a claim?

Class members are individuals residing in the United States who received a notice from Healthcare Services Group regarding the September 2024 data breach or whose private information the incident impacted.

How much can class members get?

Class members have the following benefit options:

  • Documented monetary losses: Class members can claim up to $5,000 for documented unreimbursed monetary losses traceable to the data breach. Losses may include costs for credit monitoring services incurred on or after Sept. 27, 2024, through Oct. 1, 2026, monetary losses associated with fraud or identity theft, and unreimbursed bank fees and postage for contacting financial institutions.
  • Pro rata cash payment: Class members can also submit a claim to receive a pro rata cash payment from the net settlement fund after the settlement administrator pays all other claims. The administrator will determine the final amount by the number of claims filed.
  • Credit monitoring services: All class members can elect to receive three years of single-bureau credit monitoring. Services include dark web monitoring, identity theft insurance coverage up to $1,000,000 and fully managed identity recovery services.

How to claim a settlement payment

To receive a settlement payment, class members can file a claim online or print the PDF claim form to complete and mail to the settlement administrator.

Required proof and claim information

  • Documented monetary losses claims require supporting documentation, which may include receipts, bank or credit card statements showing unreimbursed fees or fraudulent charges, invoices for service and other proof of fraud or identity theft.

When is the Healthcare Services Group data breach settlement payout date?

The settlement administrator will distribute payments to approved claimants approximately 75 days after the court grants final approval of the settlement or within 21 days of claim approval, whichever is later.

Why did this class action settlement happen?

This class action lawsuit claimed HCSG discovered a cybersecurity incident in September 2024 that potentially exposed sensitive personal information. The plaintiffs allege HCSG was negligent, breached its contracts, received unjustly enrichment and violated state consumer protection laws.

HCSG denies any wrongdoing but agreed to settle to avoid the expense and risk of further litigation.
