People who requested and paid for copies of certain medical records from HealthPort Technologies LLC (now known as Datavant LLC) in connection with a patient’s application for life or health insurance from a Pennsylvania healthcare provider may be eligible to claim up to 67.5% of their alleged overpayment from a class action settlement.
HealthPort Technologies LLC agreed to settle a class action lawsuit alleging it charged fees above the maximum allowed by Pennsylvania law for medical record requests related to life and health insurance applications.
There are several other Datavant settlements with similar allegations:
Who can file a claim?
Individuals or entities must meet all of the following criteria:
- They requested medical records from a Pennsylvania healthcare provider or facility in connection with a patient’s application for life and/or health insurance (these are often called “underwriting” requests).
- They paid HealthPort an amount exceeding the maximum basic, search and retrieval, and/or reproduction fees as set forth in 42 Pa.C.S. § 6152(a)(2)(i) of the Pennsylvania Medical Records Act.
- HealthPort did not charge them in accordance with an agreed-upon rate.
- They made the request and payment between Dec. 17, 2009, and July 23, 2026.
Eligible class members include:
- Patients who requested their own records
- Patient designees or representatives (such as family members or legal representatives)
- Individuals, lawyers, law firms or companies who paid for records on behalf of a patient
How much can class members get?
Class members who submit a valid and timely claim can receive a payment equal to 67.5% of the amount they allegedly overpaid HealthPort for basic fees, search and retrieval fees, and/or per-page copying fees for each qualifying record request. The settlement administrator will determine the exact amount based on HealthPort’s records.
The total amount available for all class members is capped at $197,720.39. If the sum of all valid claims exceeds this amount, the settlement administrator will reduce payments proportionally (pro rata). If the sum of all valid claims is less than this amount, the administrator will return any unused funds to HealthPort/Datavant.

Why is there a class action settlement?
The class action lawsuit alleged HealthPort Technologies LLC charged fees above the maximum allowed by Pennsylvania law for medical record requests made in connection with life and health insurance applications. The plaintiffs claimed these overcharges violated the Pennsylvania Medical Records Act and breached an implied contract.
HealthPort denied any wrongdoing but agreed to settle to avoid the risks, costs and delays of continued litigation.
