Patients for whom Natera performed noninvasive prenatal testing (aka Panorama) or genetic carrier screening (aka Horizon) and billed them more than $249 or $349 (depending on the test and features) between July 10, 2019, and Sept. 2, 2026, may be eligible to claim a cash payment from a class action settlement.
Natera agreed to pay $9.5 million to settle a class action lawsuit alleging its billing communications for certain genetic screening tests did not clearly inform patients about potential out-of-pocket costs.
Who can file a claim?
Class members must meet all of the following criteria:
- Natera performed noninvasive prenatal testing or genetic carrier screening on them between July 10, 2019, and Sept. 2, 2026.
- Natera billed them more than $249 for NIPT without microdeletions, more than $349 for NIPT with microdeletions or more than $349 for genetic carrier screening.
- They paid some or all of the bill out of their own pocket because insurance or a third party did not fully cover the procedures.
The settlement divides the class into two main groups:
- Group A: Individuals for whom Natera’s records show proof of out-of-pocket payment above the threshold of $249 or $349, depending on the test
- Group B: Individuals for whom Natera’s records do not show proof of payment above those amounts but who attest to the company billing those amounts
How much can class members receive?
The amount each class member can receive depends on their specific situation and the documentation available.
- For class members with proof of payment (Group A): Eligible claimants will receive a pro rata share of the net settlement fund up to the amount they paid out-of-pocket above $249 or $349, depending on the test.
- For class members without proof of payment (Group B): Eligible claimants can receive up to $50 subject to the available net settlement fund.
The actual payment amounts depend on the number of valid claims submitted.
