Consumers whose personal information the Francesca’s data breach compromised and who received a notice sent on or after Sept. 25, 2023, may qualify to claim up to $5,000 from a class action settlement. The breach occurred Jan. 12-31, 2023.

Francesca’s Acquisitions LLC agreed to settle a class action lawsuit alleging an unauthorized third party accessed its computer systems and obtained sensitive personal information.

Who can file a Francesca's claim?

Class members must meet the following criteria:

  • They resided in the United States at the time of the data breach.
  • The breach compromised their personal information.
  • They received a notice from Francesca’s regarding the the data breach.

How much can class members get?

  • Ordinary losses: Up to $1,500 for documented out-of-pocket expenses related to the data breach. This includes bank fees, postage, gas for local travel and fees for credit monitoring or identity theft insurance purchased between Jan. 12, 2023, and Nov. 10, 2025. Class members can also claim up to five hours of lost time at $25 per hour (maximum $125 and subject to the $1,500 cap).
  • Extraordinary losses: Up to $5,000 for proven monetary loss that is actual, documented, unreimbursed and most likely caused by the data breach. The loss must have occurred between Jan. 12, 2023, and Nov. 10, 2025, and not be covered by the ordinary losses category.
  • Alternative cash payment: Instead of claiming losses, class members can choose a flat payment of $50. Those who lived in California at the time of the breach can claim $75.
  • Credit monitoring: All class members can receive two years of three-bureau credit monitoring services.

How to claim a class action payment

Class members can file a claim online or download, print and complete the PDF claim form and mail it to the settlement administrator. The claim deadline is Nov. 10, 2025.

What proof or documentation is required to submit a claim?

  • All class members must provide the class member ID located on their settlement notice. Those who do not have a class member ID or misplaced theirs can request it by filling out the contact form.
  • To claim ordinary losses, class members must provide receipts or documentation, such as bank statements or bills. Self-prepared documents alone are not sufficient.
  • To claim extraordinary losses, class members must provide receipts or documentation for unreimbursed monetary loss, proof the breach most likely caused the loss and evidence they tried to recover the loss elsewhere.
  • To claim lost time, class members must describe how they spent the claimed time.

When is the Francesca’s data breach settlement payout date?

The settlement administrator will distribute payments and credit monitoring redemption codes after the court grants final approval and resolves any appeals.

Why is there a class action settlement?

The class action lawsuit alleged Francesca’s failed to protect personal information, resulting in a data breach that occurred between Jan. 12-31, 2023. The plaintiffs claimed an unauthorized third party accessed current and former employees' and customers' personal information.

Francesca’s denies any wrongdoing but agreed to settle to avoid the risks and expenses of litigation.
