Rivian $1.5M Washington Job Posting Class Action Settlement

Individuals who applied for a job in Washington state with Rivian LLC, Rivian Insurance Services LLC or Rivian Automotive LLC between Jan. 1, 2023, and March 25, 2026, may qualify to claim a cash payment from a class action settlement.

Rivian agreed to pay between $997,193.20 and $1,497,600 to settle a class action lawsuit alleging it failed to disclose wage and/or benefits information in job postings for positions in Washington as required by state law.

Who can file a claim?

Class members must meet all of the following criteria:

  • They applied for a job opening in Washington with Rivian LLC, Rivian Insurance Services LLC or Rivian Automotive LLC between Jan. 1, 2023, and March 25, 2026.
  • The job posting for the position they applied for did not disclose the wage scale or salary range for the position or a general description of all benefits and other compensation to be offered to the hired applicant OR
  • They otherwise have a claim against Rivian for any claims arising out of or relating to a violation of RCW 49.58.110, including claims for relief under RCW 49.58.060, RCW 49.58.070 and/or RCW 49.58.110, actual damages, statutory damages, interest and attorneys’ fees and costs.

The settlement administrator used Rivian’s records to identify eligible class members. There are approximately 624 class members.

Class members who applied for more than one position are still considered a single class member. Current or former employee who applied for a new position during the relevant period may also be eligible.

How much can class members receive?

Class members who submit a valid claim form are eligible to receive an equal share of the net settlement fund. The total settlement fund ranges from $997,193.20 (minimum) to $1,497,600 (maximum) depending on how many class members submit claims.

The settlement administrator will distribute the minimum fund ($997,193.20) if 50% or fewer of the 624 class members (i.e., 312 or fewer) submit valid claims. For every additional participating class member above 312, the defendant will increase the net settlement fund by $1,603.85 up to the maximum settlement fund of $1,497,600.

Each participating class member will receive an equal share up to a maximum of $5,000 per person. If the calculated individual share exceeds $5,000, the settlement administrator will distribute the excess as residual funds to the Legal Foundation of Washington. 

The settlement administrator will report payments as nonwage damages on IRS Form 1099.

How to claim a class action payment

Class members can file a claim online or download and print a PDF claim form (Page 30 of the settlement agreement), complete it and mail or email it to the settlement administrator. The claim deadline is June 22, 2026.

Required information

To file an online claim, class members must provide the notice ID and PIN printed on the settlement notice they received. Those who are unable to locate their ID and PIN should contact the settlement administrator at info@EPOASettlementRLLC.com or 833-386- 6508 and provide their full name and mailing address.

Payout options

The settlement administrator will mail checks to eligible claimants. Class members must cash checks within 180 days of issuance. After 180 days, the administrator will send uncashed funds to the state of Washington as unclaimed property.

$1.5 million settlement fund breakdown

The $1,500,000 settlement fund includes:

  • Settlement administration costs: Up to $25,000
  • Attorneys' fees: $441,792
  • Attorneys' expenses: $5,000
  • Service award to class representative: $25,000
  • Payments to eligible class members: The remainder of the fund

Important dates

  • Deadline to file a claim: June 22, 2026
  • Opt-out deadline: June 22, 2026
  • Final approval hearing: July 24, 2026

When is the Rivian wage disclosure settlement payout date?

The settlement administrator will mail settlement checks approximately 59 days after the court resolves any appeals and grants final approval to the settlement.

Why is there a settlement?

The class action lawsuit alleged Rivian LLC and its affiliates failed to disclose wage and benefits information in job postings for positions in Washington state in violation of RCW 49.58.110 and related laws.

Rivian denies any wrongdoing but agreed to settle to avoid the uncertainty, risks and costs of continued litigation.
