Consumers who received a notice stating the Eastern Radiologists data breach discovered in late 2023 compromised their private information you may be eligible to claim up to $5,000 or a pro rata cash payment, as well as medical account monitoring, from a class action settlement.

Eastern Radiologists Inc. agreed to pay $3.25 million to resolve a class action lawsuit alleging it failed to adequately protect sensitive personal and health information.

Who can file a claim?

Individuals are eligible to participate in this settlement if:

  • The data incident involving Eastern Radiologists, discovered on or around Nov. 24, 2023, impacted their private information.
  • They received notification of the data incident by or on behalf of Eastern Radiologists.

The types of information that may have been affected include:

  • Names
  • Social Security numbers
  • Home addresses
  • Phone numbers
  • Dates of birth
  • Financial account numbers
  • Driver’s license numbers
  • Patient account numbers
  • Billing account numbers
  • Health insurance plan member IDs
  • Medical record numbers
  • Dates of service
  • Provider names
  • Medical treatment information
  • Other sensitive personal information

How much can class members receive?

  • Out-of-pocket losses reimbursement: Up to $5,000 for documented, unreimbursed out-of-pocket losses that occurred after Nov. 20, 2023, are fairly traceable to the data incident. If the total valid claims for out-of-pocket losses exceed $200,000, the settlement administrator may reduce payments on a pro rata basis. Examples of eligible expenses include:
    • Costs related to identity theft or fraud (such as falsified tax returns)
    • Fees for accessing or freezing/unfreezing credit reports
    • Costs for notary, postage, copying, mileage and other charges
    • Charges for credit monitoring or other mitigative expenditures
  • Alternative pro rata payment: Instead of reimbursement for out-of-pocket losses, a pro rata payment estimated at $50 but dependent on the number of valid claims and the net settlement fund after deducting administration costs, attorneys’ fees, expenses and service awards.
  • Medical account monitoring: One year of free medical account monitoring (available in addition to either cash option) that includes dark web monitoring, $1 million dollars of medical identity theft insurance, real-time authentication alerts, high-risk transaction monitoring, security freeze assistance and victim assistance.

How to claim a settlement payment

Class members can submit the online claim form or download, print, complete and mail the PDF claim form to the settlement administrator. The claim deadline is Dec. 1, 2025.

What proof or documentation is required to submit a claim?

  • All class members must provide the unique ID and PIN located on the postcard notice they received. Online claimants must also provide the PIN from the same notice. Those who received a notice but no longer have their unique ID or PIN should contact the settlement administrator for assistance.
  • For out-of-pocket loss reimbursement, class members must provide third-party documentation showing the loss, such as receipts, bank statements, emails or other records. Self-prepared documents like handwritten receipts are not sufficient on their own.
  • For alternative cash payment or medical account monitoring claims, no documentation is required.

If filing on behalf of a deceased claimant or a minor, the claimant must provide additional documentation, such as letters testamentary, a birth certificate or court documents appointing legal guardianship.

Payout options

Eligible claimants will receive an email with instructions on payment selection. Payment options include:

  • Paper check mailed to the address provided
  • Digital payment

$3.25 million settlement fund breakdown

The $3,250,000 settlement fund includes:

  • Settlement administration costs: To be determined
  • Attorneys' fees: Up to $1,500,000
  • Attorneys' expenses: Up to $50,000
  • Service awards to class representatives: Up $2,500 each
  • Pro rata payments to eligible class members: Remainder of fund after above deductions

Eastern Radiologists will pay up to $200,000 in out-of-pocket loss reimbursement separately.

When is the Eastern Radiologists settlement payout date?

The settlement administrator will distribute payments to eligible claimants approximately 30 to 60 days after it resolves appeals and the court grants final settlement approval.

Why did this class action settlement happen?

The class action lawsuit alleged a data incident in November 2023 allowed unauthorized parties to access Eastern Radiologists’ computer network and compromised sensitive personal and health information. The plaintiffs claimed negligence, breach of contract, breach of fiduciary duty, unjust enrichment, invasion of privacy and violations of North Carolina laws.

Eastern Radiologists denies any wrongdoing but agreed to settle to avoid the risks and costs of litigation.
