
Consumers who received a notice from East Carolina Health about a data breach may qualify to claim up to $100 from a class action settlement.
East Carolina Health agreed to pay $250,000 to resolve a class action lawsuit alleging it was negligent and failed to uphold contractual and statutory duties in connection with a data security incident discovered around Dec. 21, 2023.
Who is eligible for an East Carolina Health payout?
Class members meet the following criteria:
- They are a resident of the United States.
- They received a notice from East Carolina Health informing them their personal health information may have been impacted by the data breach discovered in December 2023.
How much can class members receive?
Class members can claim one of two types of payment:
- Up to $100 for documented losses related to the data security incident
- A flat alternative cash payment of $100 (subject to pro rata adjustment depending on the number of valid claims)
How to claim a class action payment
Class members can file a claim online or download, print, complete and mail a PDF claim form to the settlement administrator. The claim deadline is Sept. 1, 2025.

Information and documentation required
- To file an online claim, class members must log in with the unique ID and PIN located at the top of their postcard notice. Those who are unable to locate their ID & PIN should contact info@EastCarolinaHealthDataSettlement.com and provide their full name and email address.
- To file a mail-in claim form, class members must provide either their class member number or their email address and name.
- For documented loss claims, class members must provide supporting documentation, including receipts, bank statements or other proof of out-of-pocket expenses related to the data breach.
$250,000 data security settlement fund breakdown
The $250,000 settlement fund covers:
- Settlement administration costs: To be determined
- Attorneys' fees: Up to $83,325
- Attorneys' expenses: To be determined
- Service award to class representative: Up to $2,500
- Payments to class members: Remainder of the fund

When is the East Carolina Health data breach payout date?
Payments will be issued approximately 75 days after after the court grants final approval of the settlement and any appeals are resolved.
