Individuals who were reported as deceased or contacted LexisNexis Risk Solutions FL about a death record reported about them on a LexisNexis Risk Solutions FL report, may be eligible to receive at least $150, and possibly $1,000 or more, from a class action settlement.

LexisNexis Risk Solutions FL Inc. has agreed to pay $13.5 million to settle a class action lawsuit. The class action alleges that the company incorrectly reported living consumers as deceased, which the plaintiff claims violated the Fair Credit Reporting Act (FCRA).

Who is eligible to submit a claim for a payout?

There are two groups of class members:

  • Contact members:
    • Individuals who contacted LexisNexis FL between Aug. 11, 2017, and Nov. 4, 2025, to inquire about a deceased notation on a LexisNexis FL product.
    • LexisNexis FL must have a record of the inquiry, which must reference terms like “deceased,” “death,” or “dead.”
    • Contact Members do not need to submit a claim to receive a payment.
  • Product members:
    • Individuals about whom an identity verification or fraud prevention transaction was run by LexisNexis FL from Aug. 11, 2017, to Nov. 4, 2025.
    • The transaction must have returned a deceased notation.
    • LexisNexis FL’s system must reflect a deceased notation associated with that person’s identifying information, which was received from national credit reporting agencies.
    • The individual must not actually be deceased.
    • Product members must submit a claim in order to receive a payment.

There are approximately 1,700 Contact Members and 59,000 Product Members identified by the settlement administrator.

How much is the class action settlement payment?

Pro rata cash payment: Class members and/or approved claimants will receive a cash payment of at least $150, possibly up to $1,000 or more. Final payment amount will be determined by the number of claims filed. Both Contact and Product members will receive the same payment amount.

How to claim a class action rebate

Contact members do not need to submit a claim, and will receive an automatic payment after the settlement is approved.

Product members must submit a claim form to receive a settlement payment. Product members can file a claim online or print the PDF claim form to mail to the settlement administrator.

  • Claim number and PIN number from official settlement notice required to submit an online claim.
  • Date of birth and last four digits of Social Security number required on claim form.

$13.5 million settlement fund breakdown

The $13,500,000 settlement fund will include:

  • Settlement administration costs: To be determined
  • Attorneys’ fees and costs: Not to exceed $4,400,000
  • Service award to the named plaintiff: Up to $7,500
  • Payments to eligible class members: Remaining settlement funds

Important dates

  • Exclusion/opt-out deadline: March 4, 2026
  • Reservation request deadline: March 4, 2026
  • Final approval hearing: March 16, 2026
  • Claim filing deadline: May 15, 2026

When is the LexisNexis FL FCRA settlement payout date?

Payments will be issued to eligible class members and claimants approximately 120 days after the court grants final approval of the settlement.

Why did this class action settlement happen?

This class action lawsuit was filed because LexisNexis FL was accused of reporting living consumers as deceased, which the plaintiff alleged violated the Fair Credit Reporting Act. The company denies the allegations and denies its reports are governed by the FCRA, but agreed to settle in order to avoid the expense and risk of continued litigation.
