LexisNexis Risk Solutions FL Inc. agreed to pay $13.5 million to settle a class action lawsuit alleging it incorrectly reported living consumers as deceased, which the plaintiff claims violated the Fair Credit Reporting Act.

There are two groups of class members:

    • LexisNexis FL must have a record of the inquiry, which must reference terms like “deceased,” “death” or “dead.”
    • Contact members do not need to submit a claim to receive a payment.
  • Product members:
    • Individuals whom LexisNexis FL ran an identity verification or fraud prevention transaction from Aug. 11, 2017, to Nov. 4, 2025
    • The transaction must have returned a deceased notation.
    • LexisNexis FL’s system must reflect a deceased notation associated with that person’s identifying information, which it received from national credit reporting agencies.
    • The individual must not actually be deceased.
    • Product members must submit a claim to receive a payment.

The settlement administrator identified approximately 1,700 contact members and 59,000 product members.
