Individuals who entered into a credit repair services agreement with Earn Co., Earn Finance Co. LLC or Credit Exterminators Inc. on or after Feb. 10, 2016, may be eligible to claim approximately $60 from a class action settlement.

Earn Co. and related parties agreed to pay $125,000 to settle a class action lawsuit alleging it violated the Credit Repair Organizations Act by using contracts with illegal provisions and charging unlawful upfront fees.

Who are the class members?

Class members are individuals who entered into a credit repair services agreement with Earn Co., Earn Finance Co. LLC or Credit Exterminators Inc. on or after Feb. 10, 2016.

The settlement administrator used the companies' records to identify class members and sent them a notice.

How much can class members get?

The settlement fund is $125,000. After subtracting approved expenses, such as administrative costs, attorneys' fees and expenses, and a service award to the class representative, the settlement administrator will distribute the fund equally among class members.

There are approximately 1,434 class members, and the estimated class member payment is $60.

No claim form required

Class members do not need to file a claim to receive payment. The settlement administrator will automatically mail checks to eligible individuals using the contact information on file. Those who wish to receive an electronic payment method can submit their selection on the settlement website.

Class members who need to update their mailing address can do so online or by contacting the settlement administrator.

$125,000 settlement fund breakdown

The $125,000 settlement fund will cover:

  • Settlement administration costs: Up to $15,000
  • Attorneys' fees: $0 (none requested)
  • Attorneys' expenses: Up to $24,000
  • Service award to class representative: $1,000
  • Payments to eligible class members: The remainder of the fund

If any funds remain after 180 days (for example, due to uncashed checks), the settlement administrator will donate 50% to the Pennsylvania Interest on Lawyers Trust Account and 50% to the Pennsylvania Legal Aid Network.

When is the Earn Co. settlement payout date?

The settlement administrator will issue payments to class members after the court resolves any appeals and grants final approval to the settlement.

Why is there a class action settlement?

The class action lawsuit alleged Earn Co., Earn Finance Co. LLC, Credit Exterminators Inc. and related individuals violated the Credit Repair Organizations Act. The plaintiffs claimed the companies used contracts with illegal provisions and charged unlawful upfront fees.

The defendants denied all wrongdoing but agreed to settle to avoid the expense and uncertainty of further litigation and possible bankruptcy.
