CorrectCare Integrated Health, LLC has agreed to pay $6,490,000 to settle a class action lawsuit for alleged negligence, breach of implied contract, and other claims related to a data breach.

Can I Claim an Award?

To be part of the settlement, you must have had your personal information compromised as a result of the data incident that CorrectCare discovered on or around July 6, 2022. If you received a notice about this data breach, you are likely included in the class of affected individuals.

Class members are those whose personal information was exposed due to the data incident. This includes individuals whose medical claims were processed by CorrectCare and whose information was made accessible to unauthorized individuals.

  • If you are on the class list, you are eligible to receive a payment.
  • Class members eligible for a California Additional Cash Payment will automatically receive this payment upon submitting a valid claim for either out-of-pocket losses or an alternative cash payment.

What Awards Can Class Members Claim?

Class members can claim reimbursement for out-of-pocket losses or an alternative cash payment. Additionally, eligible California residents can receive an extra payment.

Out-of-pocket losses can be claimed up to $10,000 per claimant for expenses directly traceable to the data incident. This includes bank fees, phone charges, costs for credit reports, and actual fraud that occurred between the date of the data incident and August 27, 2024.

  • Out-of-Pocket Losses: Up to $10,000 per claimant for expenses like bank fees, phone charges, and fraud costs.
  • Alternative Cash Payment: A pro rata payment from the net settlement fund for those who do not claim out-of-pocket losses.
  • California Additional Cash Payment: An additional amount equal to half of the alternative cash payment for eligible California residents.

If the amount of valid claims for Out-of-Pocket Losses exceeds the limit for all claimants under the settlement, then each payment will be reduced pro rata until all payments total the limit for all claimants.

For example, if the total valid claims amount to $7,000,000 but the settlement fund is only $6,490,000, each claim will be reduced proportionally.

Is Proof Required to Claim the Reward?

Yes, proof is required to claim the reward. Claimants must provide documentation of their losses to prove they are fairly traceable to the data incident.

  • Out-of-pocket losses require written documentation of the loss.
  • Alternative cash payments require basic claim information.

$6,490,000 Settlement Fund Breakdown

The settlement amount is $6,490,000. This fund will cover payments to class members, attorneys' fees, costs of notice and administration, and service awards to class representatives.

Class counsel will request up to one-third of the settlement fund for attorneys' fees, plus reasonable expenses. Service awards of up to $2,500 will be requested for each of the four class representatives.
