CommuniCare $1M Foreign-Trained RNs Class Action Settlement

Foreign-trained registered nurses CommuniCare sponsored through the immigration process between Feb. 17, 2013, and Oct. 13, 2025, may be eligible to claim a cash payment from a class action settlement.

Healthcare Facility Management LLC, doing business as CommuniCare Family of Cos., and WorldWide HealthStaff Solutions LLC agreed to pay $1,000,000 to settle a class action lawsuit alleging unlawful employment practices. The lawsuit claimed the companies required nurses to pay substantial fees if they left before the end of their contract terms, as well as other wage-and-hour claims.

Who are the class members?

Class members must meet all of the following criteria to be eligible for payment:

  • They are a foreign-trained registered nurse.
  • CommuniCare sponsored them through the immigration process.
  • They worked for CommuniCare at any time from Feb. 17, 2013, through Oct. 13, 2025.

The settlement administrator identified class members based on employment records CommuniCare and WorldWide HealthStaff Solutions maintained. If they received a postcard, email or text notice about the settlement, they are likely a class member.

There are two groups within the class:

  • Settlement class: All eligible nurses as described above
  • Settlement collective (FLSA collective): Those who opt in to pursue Fair Labor Standards Act claims for additional compensation

How much can class members get?

The amount each class member can receive depends on several factors:

  • Class members who paid CommuniCare any money for leaving before their contract ended will receive approximately half of that amount back.
  • All class members will receive a share of the remaining settlement funds based on the number of weeks they worked for CommuniCare. The longer they worked, the higher their share.
  • Class members who opt in to the FLSA settlement collective will increase their non-reimbursement share by approximately 10%.

How to submit a claim

Class members do not need to file a claim to receive the base settlement payment. The settlement administrator will use employment records to determine eligibility and payment amounts.

However, to receive the additional FLSA collective payment, class members must submit an FLSA opt-in and release form either online or by downloading, printing and mailing the PDF claim form to the settlement administrator.

Class members who moved or want to update their payment method should contact the administrator.

Claim instructions

Class members who wish to receive the additional FLSA collective payment must:

  1. Either complete the FLSA opt-in online claim form by logging in with the credentials from the settlement notice they received OR
  2. Download the PDF claim form, print it and fill it out.
  3. If using the PDF claim form, mail it to CommuniCare/WorldWide Settlement, c/o Atticus Administration, PO Box 64053, St. Paul, MN 55164.
  4. Ensure they postmark the PDF Form or submit the online form by June 4, 2026.

Payout options

  • Direct deposit to the last bank account on file with CommuniCare
  • Check mailed to the class members last known address
  • Alternative electronic payment methods (such as Zelle or Venmo) if elected on the settlement website

$1 million settlement fund breakdown

The $1,000,000 settlement fund covers:

  • Settlement administration costs: Up to $12,000
  • Attorneys' fees, costs and expenses: Up to $338,100
  • Service award to class representative: $15,000
  • Payments to eligible class members: The remainder of the fund

If any funds remain unclaimed after 180 days, the settlement administrator will donate them to the Human Trafficking Legal Center.

When is the CommuniCare settlement payout date?

The settlement administrator will issue payments after the court resolves any appeals and grants final approval to the settlement.

Why did this class action settlement happen?

The class action lawsuit alleged CommuniCare and WorldWide HealthStaff Solutions required foreign-trained nurses to pay substantial fees if they left before their contract ended and engaged in other employment practices that may have violated wage-and-hour laws.

The companies deny any wrongdoing but agreed to settle to avoid further litigation costs and risks.
