
Club One player rewards program members at Circa, The D or Golden Gate casinos between Oct. 23, 2020, and Dec. 31, 2025, who redeemed comp dollars for food, meals or nonalcoholic beverages may be eligible to claim comp dollars from a class action settlement.
Circa Hospitality Group LLC and its related entities agreed to provide $800,000 in comp dollars to resolve a class action lawsuit. The lawsuit alleged they improperly reduced the value of comp dollars Club One members earned by deducting both the menu price and the associated sales tax when members redeemed their comp dollars for food, meals or nonalcoholic beverages at Circa, The D or Golden Gate properties.
Who are the class members?
The settlement class includes all U.S. citizens who were Club One members between Oct. 23, 2020, and Dec. 31, 2025, who redeemed comp dollars at Circa, The D or Golden Gate in exchange for food, meals or nonalcoholic beverages and whose comp dollars the casinos reduced proportionally to the menu price and the associated sales tax of the food, meals or nonalcoholic beverages.
The settlement administrator identified class members based on the defendants’ records. If a person received a notice by email or postcard, the administrator identified them as a class member. The settlement administrator and class counsel have access to the necessary records to determine eligibility.
The settlement covers nearly 100,000 Club One members.
How much can class members get?
The total settlement fund includes $800,000 in comp dollars, which the administrator will distribute equally among all qualifying members who do not opt out of the settlement. Each class member will receive an equal share credited directly to their Club One account.
The comp dollars are nontransferable and valid for nine months from the date Circa Hospital Group credits them to the member’s Club One account. There is no cash payment; the award is in the form of comp dollars that the class member can redeem at Circa, The D or Golden Gate for food, meals or nonalcoholic beverages.
No action needed to receive comp dollars
Class members do not need to file a claim to receive their comp dollars. Circa Hospital Group will automatically credit them to each qualifying member’s Club One account by Dec. 31, 2026.
Those who wish to exclude themselves from the settlement must send a written request to the settlement administrator by mail or email. The request must include:
- Name
- Address
- Telephone number
- A statement, such as: “I request to be excluded from the settlement class in David Chitwood, et al. v. Circa Hospitality Group LLC, et al., No. A-23-882231-C, pending in the District Court of Clark County, Nevada.”
- Signature and date (electronic or scanned signatures are acceptable)
The deadline to request exclusion is June 21, 2026.

Why is there a class action settlement?
The class action lawsuit alleged Circa Hospitality Group LLC and its related entities reduced the value of comp dollars Club One members earned by deducting both the menu price and associated sales tax when members redeemed comp dollars for food, meals or nonalcoholic beverages. The plaintiffs claimed this practice deprived members of the full value of their earned comp dollars.
The defendants denied all allegations of wrongdoing but agreed to settle to avoid the uncertainty and expense of further litigation and to provide benefits to class members.
The settlement also includes injunctive relief, requiring Circa Hospitality Group to ensure Club One Program policies and procedures regarding comp dollar redemptions comply with Nevada law.
