
Consumers who paid any amount of money for retail purchases of Chantix in the United States or its territories between Sept. 29, 2015, and Sept. 17, 2021, may be eligible to claim a cash payment from a class action settlement.
Pfizer Inc. agreed to pay $44 million to settle a class action lawsuit alleging its prescription medication Chantix contained an undisclosed nitrosamine contaminant. Nitrosamine is a probable human carcinogen.
Who can file a claim?
Class members must have paid any amount of money for retail purchases of Chantix in the United States or its territories between Sept. 29, 2015, and Sept. 17, 2021. Eligible expenses include out-of-pocket costs, such as copayments, coinsurance or deductibles for Chantix prescriptions.
The settlement includes both individuals and third-party payers (such as health plans or insurers) if they paid for retail purchases of Chantix during the specified period.
Class members must have purchased the medication at retail for personal or covered use and not for resale or distribution.
How much can class members get?
The settlement fund is $44 million. However, the settlement caps the amount available to individual consumers at 20% of the net settlement fund after deductions for attorneys’ fees, litigation costs, settlement administration expenses and service awards to class representatives. The settlement allocates the remaining 80% to third-party payers.
The settlement administrator will distribute payments to eligible class members on a pro rata basis. It may reduce payments if the total amount class members claim exceeds the available consumer fund.

$44 million settlement fund breakdown
The $44,000,000 settlement fund will cover:
- Settlement administration costs: To be determined
- Attorneys’ fees: Up to $14.67 million
- Attorneys’ expenses: To be determined
- Service awards to class representatives: $15,000 each for third-party payor plaintiffs and $5,000 each for consumer plaintiffs
- Payments to class members: Up to 20% of the net fund for consumers and 80% for third-party payers

When is the Chantix settlement payout date?

Why did this class action settlement happen?
The class action lawsuit alleged Pfizer failed to comply with current good manufacturing practices, resulting in Chantix being contaminated with nitrosamine. The plaintiffs claimed this led to breaches of warranty, violations of consumer protection laws, negligent misrepresentation and unjust enrichment.
Pfizer denies any wrongdoing but agreed to settle to avoid the costs and uncertainties of continued litigation.
