Cerebral Inc. account holders with California addresses who received a data incident notification letter around March 6, 2023, may be eligible to claim a cash payment and/or $300 credit from a class action settlement.

Cerebral Inc. agreed to pay $500,000 to settle a class action lawsuit alleging it disclosed users’ personal and health information to Facebook by using the Meta pixel on its website. The lawsuit claimed this may have compromised personal identifying information and/or protected health information, potentially violating California law.

Who are the class members?

Class members must be current or former Cerebral Inc. account holders with a California address who received a data incident notification letter from Cerebral on or about March 6, 2023, by email or mailed postcard.

How much can class members receive?

Eligible class members can claim one or both of the following awards:

  • A $300 credit toward amounts billed as self-pay for services under a Cerebral Therapy & Medication plan that class members must redeem within 120 days of issuance
  • A cash payment consisting of a pro rata share of the net settlement fund

The net settlement fund available for cash payments is approximately $267,000 after deductions for attorneys’ fees, litigation costs and service awards to the plaintiffs. The amount each class member receives will depend on the total number of valid claims submitted as the settlement administrator will divide the fund equally among all approved claimants who select the cash option.

How to claim a class action payment

Class members can file a claim online or download, print, complete and mail or email the PDF claim form to the settlement administrator. The claim deadline is Jan. 22, 2026.

What proof or documentation is necessary to submit a claim?

  • All class members must provide the class member ID from their settlement notice to file a claim.
  • They must also provide the full name, address, phone number and email address associated with the Cerebral account.

  • Paper check (default payment option)
  • Electronic transfer (online claims only)
  • Instructions for redeeming $300 credit

$500,000 settlement fund breakdown

The $500,000 settlement fund will cover:

  • Attorneys’ fees: Up to $198,000
  • Attorneys’ costs expenses: Up to $25,000
  • Service awards to class representatives: Up to $10,000 total ($5,000 each for two plaintiffs)
  • Payments to eligible class members: Approximately $267,000 (net settlement fund)

Cerebral will pay notice and administration costs of up to $100,000 separately from the settlement fund. The settlement administrator will deduct any notice and administration costs in excess of $100,000 from the net settlement fund. 

Important dates

  • Deadline to opt out: Dec. 23, 2025
  • Deadline to file a claim: Jan. 22, 2026
  • Final approval hearing: March 9, 2026

When is the Cerebral settlement payout date?

The settlement administrator will distribute payments and credits approximately 45 days after the court resolves any appeals and grants final approval of the settlement.

Why is there a class action settlement?

The class action lawsuit alleged that Cerebral Inc. disclosed users' personal and health information to Facebook through its use of the Meta pixel on its website. The plaintiffs claimed this disclosure violated California Business & Professions Code section 17200.

Cerebral denies any wrongdoing but agreed to settle to avoid the costs and risks of litigation and trial.
