Central Transport $5.5M Driver Discrimination Settlement

Women who applied for a truck driver position at Central Transport LLC between Jan. 1, 2016, and the present and held a CDL A license but whom the company denied employment may be eligible to claim a cash payment of at least $2,500 from a class action settlement.

Central Transport agreed to pay a confidential settlement amount to resolve a class action lawsuit the Equal Employment Opportunity Commission filed. The lawsuit alleged Central Transport engaged in a nationwide pattern or practice of sex discrimination by failing or refusing to hire qualified female truck driver applicants because of their sex. These actions allegedly violated Title VII of the Civil Rights Act of 1964.

Who can file an EEOC claim?

Class members must meet all of the following criteria:

  • They are female.
  • They applied for a truck driver position with Central Transport by submitting a paper or electronic application at any terminal or facility nationwide from Jan. 1, 2016, to the present.
  • They held a Class A Commercial Driver’s License at the time of the application.
  • Central Transport denied them employment as a truck driver at least once during this period.

How much is the discrimination payout?

The minimum payment for each eligible claimant is $2,500. However, the actual amount could be higher, depending on the number of valid claims submitted and the allocation decisions made by the EEOC, which has full discretion to determine the final payment amounts.

The EEOC will divide payments as follows:

  • 25% of the payment as backpay wages (reported on IRS Form W-2).
  • 75% of the payment as compensatory damages (reported on IRS Form 1099).

How to claim a Central Transport payout

Class members must complete and submit a claim form. They can file a claim online or print the PDF claim form to complete and mail to the settlement administrator. Claimants can also request a claim form by calling the settlement administrator. Class members need the claim number and PIN from the email or claim form they received from the EEOC to log into the online claim form.

Is proof or documentation required to submit a claim?

Yes. Claimants must provide information about their application(s) for employment as a truck driver with Central Transport, including:

  • The approximate dates, months or years they applied
  • The terminal or facility where they applied (city and/or state)
  • Confirmation that they held a CDL A license at the time of application
  • Certification under penalty of perjury that the information provided is true, correct and complete

The settlement administrator may request additional information if needed to verify the claim.

Payout options

The settlement administrator will issue payment by direct deposit to a bank account (requires routing and account number).

Those whose address changes after they submit a claim should notify the settlement administrator by email or mail with their updated information to ensure they receive all communications and any potential payment.

Why is there a class action settlement?

The EEOC filed this lawsuit on behalf of qualified female truck driver applicants whom Central Transport denied employment. The lawsuit alleged Central Transport engaged in a nationwide pattern or practice of sex discrimination in violation of Title VII of the Civil Rights Act of 1964 by failing or refusing to hire qualified female applicants because of their sex.

Central Transport denies these allegations but agreed to settle the claims to resolve the litigation. The settlement provides compensation to eligible female applicants and requires Central Transport to consider such applicants without discrimination or retaliation in the future.
