Individuals who received a notice from Calibrated Healthcare Systems LLC or Calibrated Healthcare LLC regarding a data breach that occurred in February 2024 may be eligible to claim a cash payment and credit monitoring from a class action settlement.

Calibrated Healthcare Systems LLC and Calibrated Healthcare LLC agreed to pay $1.75 million to resolve a class action lawsuit alleging they failed to protect patient information, leading to unauthorized access to confidential data during a security incident in February 2024.

Who are the class members?

The settlement class includes approximately 34,562 individuals whose confidential information the February 2024 data breach may have been compromised.

Class members must have received a written notice from Calibrated Healthcare Systems LLC or Calibrated Healthcare LLC about the data breach.

The types of information potentially compromised include:

  • Names
  • Dates of birth
  • Medical diagnoses or treatment information
  • Health insurance information, including claims and billing data
  • For some individuals, Social Security numbers and/or driver’s license numbers

How much can class members get?

  • Credit monitoring: Two years of free medical monitoring and identity theft insurance services (Medical Shield Total by CyEx)
  • Lost time: A cash payment for up to seven hours of documented time fairly traceable to the alleged data breach at $25 per hour ($175 total)
  • Out-of-pocket costs: Up to $5,000 for documented losses and/or out-of-pocket costs fairly traceable to the alleged data breach
  • Monetary payment: A pro rata payment estimated between $21.44 and $28.68, depending on the amount remaining in the net settlement fund after deductions for administrative expenses, attorneys' fees, service awards, and payments for documented time and out-of-pocket costs

How to claim a class action payment

Class members do not need to file a claim form to receive credit monitoring or the pro rata payment. The settlement administrator will automatically send these benefits to eligible class members after the court grants final approval to the settlement.

To claim compensation for documented time or out-of-pocket costs, class members can submit a claim form online or by downloading and printing the PDF claim form to complete and mail to the settlement administrator.

What proof or documentation is required to submit a claim?

  • For documented time claims, class members must provide reasonable documentation (such as credit card statements, bank statements, invoices, telephone records or receipts) and sign an attestation under penalty of perjury.
  • For out-of-pocket costs claims, class members must provide reasonable documentation of their expenses (such as receipts, statements or correspondence) and sign an attestation under penalty of perjury.
  • For online claims, class members must provide the unique ID and PIN from the settlement notice they received. Those do not have a unique ID or PIN or cannot locate theirs should contact the settlement administrator by email at info@CalibratedSettlement.com.

$1.75 million settlement fund breakdown

The $1,750,000 settlement fund includes:

  • Settlement administration costs: Up to $135,000
  • Attorneys' fees and costs: Up to $575,000
  • Service awards to class representatives: $5,000 each ($10,000 total)
  • Payments to eligible class members: Remainder of the fund

Calibrated Healthcare Systems LLC and Calibrated Healthcare LLC will pay an estimated $630,000 in enhanced security measures and approximately $24,843,165.60 in credit monitoring costs separate from the $1,750,000 settlement fund.
