
Individuals who worked as hourly, nonexempt employees for FN Logistics LLC or its predecessor, FN Logistics Inc., in California between Jan. 13, 2019, and Dec. 31, 2024, or as temporary employees a staffing agency placed at FN Logistics during that time may be eligible to claim a cash payment from a class action settlement.
FN Logistics agreed to pay $5.57 million to settle a class action lawsuit alleging violations of California wage-and-hour laws, including claims of unpaid overtime, missed meal and rest breaks, unreimbursed expenses and other labor code violations.
Who are the class members?
Class members include:
- All current and former hourly, nonexempt employees who worked for FN Logistics or its predecessor in California at any time from Jan. 13, 2019, through Dec. 31, 2024
- All temporary employees who worked for FN Logistics or its predecessor at any California location during the same period and whom any temporary or staffing agency hired or placed
There is a also a Private Attorney General Act class, which includes all class members who worked for FN Logistics LLC or its predecessor at any California location at any time from Oct. 2, 2021, through Dec. 31, 2024.
How much are settlement payments?
Class members can receive one or more of the following payments:
- Class fund: Eligible class members can receive a pro rata cash payment form the net settlement fund. The settlement administrator will determine the payment amount by the number of workweeks the class member worked during the class period.
- PAGA payment: The settlement administrator will split the $200,000 PAGA settlement fund with 25% ($50,000) to qualifying class members and 75% ($150,000) to the California Labor and Workforce Development Agency. The settlement administrator will determine the payment amount by the number of pay periods the class member worked during the PAGA period.
How to claim a class action payment
If a class member received a notice by mail, they do not need to take any action. If they did not receive a mailed notice but believe they are a class member, they must file a claim to participate. They may do this by using the online claim form; downloading, printing and completing the PDF claim form; or requesting a paper claim form from the settlement administrator.

Is proof or documentation required to submit a claim?
Claimants who did not receive a mailed notice must provide copies of pay stubs or other records that prove the number of workweeks they worked during the class period.

The $5,565,000 settlement fund includes:
- Settlement administration costs: Up to $32,000
- Attorneys’ fees: Up to $1,947,750
- Attorneys’ expenses: Up to $52,250
- Service awards to class representatives: Up to $10,000 each ($40,000 total)
- PAGA LWDA penalties and payments to class members: $200,000
- Class fund payments to eligible class members: Remaining settlement funds

When is the FN Logistics payout date?
The settlement administrator will issue checks to eligible class members after the court resolves any appeals and grants final approval of the settlement.
Why is there a class action settlement?
The lawsuit alleged FN Logistics and its staffing agencies violated California labor laws by failing to:
- Pay all overtime wages
- Pay minimum wages
- Provide meal and rest breaks
- Reimburse expenses
- Issue accurate wage statements
The plaintiffs also sought civil penalties under PAGA for these alleged violations.
FN Logistics denied any wrongdoing but agreed to settle to avoid the costs and risks of further litigation.
