Individuals who received a telemarketing text message from Big Sandy Furniture Inc. between May 15, 2020, and May 15, 2024, and did not provide prior express written consent were eligible to claim up to $100 in cash or a $250 voucher from a class action settlement.
Big Sandy Furniture Inc. agreed to pay $14 million to resolve a class action lawsuit alleging it sent marketing text messages to consumers without their prior express consent in violation of the Telephone Consumer Protection Act and Florida Telephone Solicitation Act.
Who could file a claim?
Individuals needed to meet all of the following criteria:
- They received a telemarketing text message from Big Sandy Furniture Inc. or Acima relating to Big Sandy Furniture Inc. between May 15, 2020, and May 15, 2024.
- They did not provide prior express written consent to receive such messages.
- They were located within the United States at the time they received the message.
Who was excluded from the class?
- Anyone who purchased, rented or leased goods from Big Sandy Furniture Inc. less than 18 months before receiving the last text message
- Anyone who inquired about or applied for Big Sandy Furniture Inc.’s goods or services less than three months before receiving the last text message
- Anyone who had an ongoing financial relationship with Big Sandy Furniture Inc. at the time they received the text messages
How much is the Big Sandy payout?
Each class member who submitted a valid, timely and verified claim form is eligible to receive either:
- Up to $100 in cash OR
- Up to $250 in the form of a voucher for use toward the purchase of Big Sandy Furniture Inc. products
The settlement administrator may adjust the final payment and/or voucher amount depending on the total number of valid claims submitted and deductions for attorneys’ fees and costs, administration costs and service awards from the $14 million settlement fund.
How to claim a class action rebate
Class members could submit the online claim form or download, print and complete the PDF claim form and mail it to the settlement administrator.

The settlement administrator will send payments to the address class members provide on the claim form.

The $14,000,000 settlement fund includes:

- Attorneys' fees and costs: Up to $2,800,000
- Service award to class representative: Up to $7,500
- Payments to approved class members: Remainder of the fund

When is the Big Sandy Furniture TCPA settlement payout date?
The settlement administrator will issue payments to class members within 60 days after the court resolves any appeals and grants final approval to the settlement.
Why is there a class action settlement?
The class action lawsuit alleged Big Sandy Furniture Inc. sent marketing text messages to consumers without first obtaining their prior express consent, violating the TCPA and FTSA.
The company denied all allegations and any liability. Both parties agreed to settle to avoid the costs and uncertainties of litigation.
