Patients and employees who were directly or indirectly notified by Boston Children’s Health Physicians LLP that their private information may have been impacted by a September 2024 data incident may qualify to claim up to $5,000 from a class action settlement.

Boston Children’s Health Physicians LLP agreed to pay $5.15 million to resolve a class action lawsuit alleging it failed to adequately protect personal information during a data breach. The lawsuit claims a cyberattack on BCHP’s IT provider, ATSG Inc., exposed the sensitive information of approximately 918,000 patients and employees.

Who can file a Boston Children's Health Physicians claim?

Class members are eligible to file a claim if Boston Children’s Health Physicians LLP directly or indirectly notified them that their private information may have been affected by the September 2024 data incident.

  • Both patients and employees whose data was stored on BCHP’s network (and managed by ATSG) are eligible.
  • Notification could have been sent directly to the class member or to someone acting on their behalf, such as a parent or guardian.

How much can class members get?

  • Cash payment A – documented losses: Up to $5,000 per class member for documented out-of-pocket losses related to the data incident.
  • Cash payment B – undocumented cash claim: An estimated $100 cash payment for class members without documentation of losses. This amount may increase up to $350 or decrease depending on the number of valid claims and the total settlement fund available.
  • Medical data monitoring: All class members are eligible for two years of Cyex Medical Shield Medical Data Monitoring, which includes medical identity monitoring, real-time alerts and up to $1,000,000 in insurance coverage for medical identity theft.

How to claim a settlement payment or benefit

Class members can submit an online claim form or download, print, complete and mail the PDF claim form to the settlement administrator. Claims must be submitted online or postmarked by Nov. 25, 2025.

What proof or documentation is required to submit a claim?

  • All class members must provide the class member ID located on their email or postcard notice.
  • For cash payment A, class members must provide receipts or other non-self-prepared documentation showing out-of-pocket expenses related to the data incident. Handwritten receipts alone are not sufficient but may supplement other documentation.
  • For cash payment B or medical data monitoring claims, class members need only check the appropriate box.

When is the BCHP data breach settlement payout date?

Payments and benefits will be distributed approximately 61 days after the court grants final approval of the settlement and any appeals are resolved.
