If you worked as a non-exempt hourly employee for Audiology Distribution, LLC, or its affiliates, you may be eligible to claim an award from a class action settlement.

Audiology Distribution has agreed to pay $1,800,000 to settle a class action lawsuit for alleged violations of wage and hour laws, including failure to pay overtime and provide accurate wage statements.

Who are the class members?

The class members include non-exempt hourly employees who worked for Audiology Distribution, LLC or its affiliates.

  • FLSA Regular Rate Class: Employees outside of California who received commissions or bonuses between June 22, 2019, and July 19, 2024.
  • California Regular Rate Class: Employees in California who received commissions or bonuses between December 26, 2017, and July 19, 2024.
  • California Itemized Wage Statement Subclass: California employees who worked between December 26, 2020, and July 19, 2024.
  • California Waiting Time Penalties Subclass: California employees who worked between December 26, 2018, and July 19, 2024.

These classifications help determine eligibility and the specific claims that can be made under the settlement.

How much can class members get?

The settlement provides for a Net Settlement Amount, which will be distributed among the class members. Each member will receive at least $25. The remaining funds will be distributed on a pro-rata basis, based on the potential value of their claims.

For example, if the Net Settlement Fund is $1,109,100, and your claim is valued higher than $25, your share will be calculated based on your individual claim's potential value compared to the total value of all claims.

  • FLSA Regular Rate Class Members: Must submit a claim to receive payment.
  • California Class Members: Automatically receive payment unless they opt out.

The pro-rata calculation ensures that each member receives a fair share of the settlement based on their individual circumstances.

How to claim cash benefits

If you worked in California, you do not need to take any action to receive your settlement payment. However, if you worked outside California, you must file a claim online or download the claim form and mail it to the Settlement Administrator.
