Individuals who received notice that the December 2023 AGC America cyberattack may have compromised their information could qualify to submit a claim for up to $2,500 and/or credit monitoring from a class action settlement. The data breach impacted approximately 20,951 people.

AGC America Inc. agreed to pay $597,000 to settle a class action lawsuit alleging it failed to adequately protect personal information during a targeted cyberattack. The incident, which occurred in December 2023, may have exposed sensitive data such as names, addresses, Social Security numbers, driver’s license numbers, financial account details and other personal information.

Who can file a claim for a data breach payout?

Class members are individuals residing in the United States whom AGC America sent a notice of the December 2023 data breach indicating their private information may have been impacted.

How much will settlement payments be?

Class members have the following benefit options:

  • Documented losses: Class members can claim up to $2,500 in actual out-of-pocket losses traceable to the data breach that occurred between Dec. 14, 2023, and July 15, 2026. Eligible expenses include fees for credit reports, credit monitoring or freezing/unfreezing credit, monetary losses due to identity theft or fraud, costs to replace IDs and postage for contacting financial institutions.
  • Alternative cash payment: Class members who do not submit a documented losses claim can submit a claim to receive a one-time cash payment estimated at $50. The settlement administrator will determine the final payment amount by the total number of claims filed.
  • Credit monitoring and insurance services: All class members can elect to receive two years of CyEx Financial Shield Complete, which includes monitoring for identity theft, unauthorized financial transactions and high-risk personal information activity, $1 million in financial fraud insurance and access to fraud resolution agents if necessary.

To receive a settlement payment, class members can file a claim online or print a PDF claim form to complete and mail or email to the settlement administrator.

When is the AGC America data breach settlement payout date?
