Depop adds a marketplace fee when customers check out, a new class action lawsuit alleges.

Javier Rivera filed a class action lawsuit against Depop Inc. on Sept. 15, 2026, in the U.S. District Court for the Northern District of Illinois.

The class action lawsuit alleges the resale marketplace adds a mandatory marketplace fee to every order but withholds it until the final payment screen, a practice the complaint calls "drip pricing."

What is Depop?

Depop is an online marketplace for secondhand clothing and accessories with more than 50 million registered users, according to the complaint. eBay bought the company from Etsy in July 2026.

How Depop allegedly conceals the fee

Screenshots in the complaint show Depop listing an item's price in search results, on the product page and in a customer's shopping bag, where it appears with a note that Depop calculates shipping at checkout.

The fee only shows up on the final payment screen after the shopper enters shipping and payment details, the lawsuit claims. It contends that many buyers never notice it and those who do often finish the purchase rather than start over.

Rivera's reported purchase

On or about Aug. 31, 2025, Rivera claims he bought an item listed at $400. The lawsuit alleges Depop calculated $7.99 in shipping costs and $43.94 in sales tax but did not display a $20.70 fee until the final payment screen using small text.

Rivera says he did not notice the fee until after he completed the order and would have shopped elsewhere if Depop disclosed the full price up-front.

The legal claims

The lawsuit brings two claims against Depop:


  • Illinois Consumer Fraud and Deceptive Business Practices Act, a state law that bars deceptive or unfair practices in consumer transactions

  • Unjust enrichment, a legal theory that applies when a company keeps money it obtained unfairly at someone else's expense

Rivera seeks compensatory damages, restitution, disgorgement, declaratory and injunctive relief, prejudgment interest and attorneys' fees.

What the lawsuit means for Depop shoppers

The proposed nationwide class covers everyone who paid the marketplace fee or a similar charge on Depop within the statute of limitations period plus an Illinois subclass the complaint does not define.

The case remains pending before the federal court in Chicago. As of this writing, there is no settlement, no claims process and no money available.
